      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I really need help. I have a Natwest overdraft which I ran up as a student and then ignored/forgot about after moving away from parents and buying a flat with my partner. The debt has caught up with me though and is now being dealt with by AIC. I have had several phone conversations with different people at AIC and before Christmas I was offered the opportunity to pay the debt off in one reduced lump sum. I asked if this could be sent out in writing and received nothing. I also heard nothing up until last week when I received a final notice of intent stating that if I now don't pay the full amount, a claim will be issued through my local county court. I can see from my credit file that a default has also been added to the account and this is my main worry as I know this will stay against me for 6 years.

 

The thing is, had they confirmed in writing that they would close the matter after I paid the reduced amount all of this would have been dealt with before Christmas. I now have a default and the threat of a CCJ if I don't pay the full amount. I haven't contacted AIC about the letter as I don't know what to do. The default makes me feel sick.

 

Can anyone advise what I should do?

and nothing can unbar it. not even a judge

 

STOP talking to these muppets on the phone

you are under no legal obl to do so.

 

as they are offering a 'discount', this points to one thing........

 

the balance is mostly unlawful charges

 

they will go nowhere near a court

 

they are a dca with NO LEGAL POWERS

Thanks for your reply.

 

The account isn't statute barred as my last credit was in 2007 so this makes me feel like I need to do something about it. I understand what you mean about not speaking to them on the phone which is why I asked for the reduced offer to be sent in writing but obviously I received nothing.

 

It's the default on my credit file that is my main worry - would this have been done by AIC or Natwest?

 

I feel like I need to respond to the letter of final intent as I know I do have a debt with natwest and I would rather have a line drawn under it all but I don't want to be taken for a fool or make the situation worse...

if the oc wanted their money.why wait for 4yrs?

 

they wrote it off against tax years ago and these fleecers have brought it.

 

how long after your last payment has this default been marked?

 

is it their name against the a/c or natwest?

then next comms is a default 31/1/11?

 

thats not allowed

 

the guidelines state that defaults much be placed within 3 months of the 'offence' at the outside 6mts

 

not 4yrs!

 

something funny going on here.

 

also, i bet the O/D is all charges too!

 

i think AIC are natwests inhouse pets anyway
