What to do with this letter from C.A.R.S ?

Because Eclipse will have 40 days to comply,it is highly likely that C.A.R.S will continue to press for payment.

I therefore think it will be a good idea to just write a simple letter advising them of the position.

Hi, what do you mean by this Registration Number: Z8036636

Date Registered: 09 July 2003 Registration Expires: 08 July 2011.

 

I think eclipse perhaps sell the debt to debt collection agencies i.e. C.A.R.S

 

It is extremely unlikely given the age of the account that it has been assigned (Sold)

 

You should try and get a copy of your credit file to see whats been recorded there-for £2 this will be well worthwhile.

The ICO registration details are for Eclipse.

I think it may not of been sold actually as they say creditor: eclipse on all letters.

I was planning on sending the letters tomorrow. But i thought i would send an email to a individual person within C.A.R.S. And i received this reply today.

Thank you for your complaint dated 4th February. Please accept my apologies for our delay in responding to your letter.

 

The service Eclipse Internet provide is not regulated by the credit consumer act so we have returned your £1 that you posed us as they would not be able to provide a credit agreement. I Have however sent a message to our client to post you a copy of the agreement along with an invoice.

 

In line with your subject access request we would require a payment of £10.00 to provide this.

 

I have placed your account on hold and if you have any other queries please do not hesitate to contact me.

Apart from sending the £10, what do you think my next steps should be ?

I would send the £10 with the Sar to Eclipse and then wait and see what they send you in regards to the copy of the agreement and invoice, as the agreement terms may be key here. So doing anything else before seeing that is not likely to get you anywhere without knowing what is contained within the agreement. Once we know what is in the agreement then we can devise an appropriate response to it.

 

P.s. i still fail to see where Pipex came into this or why they were named as creditors/original party to whom the debt was allegedly owed too - Doesn't make sense whne they are a seperate company to eclispse. Hopefully the SAR will provide some light as to where Pipex come into this.

The SAR needs to be done by way of suface mail not email.

Follow the guidance given previously.

C.A.R.S. Have indicated that the account is on hold with them,so for the moment theres not much to do.
