Hi wonder if you could clarify something for me, just had a baillif from equita at the door, saying they were coming back at the weekend to remove goods, they have never been in the property and have threatened with the police and locksmiths to get in, this is for councl tax by the way thought that if they never gained entry they could not force entry any advice would be appreciated. Thank u in advance

Never let them in, as unless they gain peaceful entry, they cannot break in or use a locksmith to pick your lock. the police if they bother to attend are not supposed to actively help the bailiff, they are merely there to keep the peace.

 

They are like vampires in that they have virtually no power unless you invite them in.

 

Did he give you anything in writing? If he did did you sign it?

 

You need to contact the council and ask them how much the Liability Order is for

Hi thanks he did hand me an envelope demanding payment within 24hours but i have never let them in or signed anything,

 

open the envelope and check what is written there, as this will have a bearing on the advice, you will likely have to post up the details, so that you can get the best advice for the situation.

Before they can remove goods they must levy upon them and since he has not entered your home then the only other way a levy can be performed is if you have a car registered in your name parked outside the house.

 

There is no law in statute that says you have to speak with this bailiff, his assumption that your refusal to do so means you are refusing to pay is exactly that ...an assumption.

 

Work out exactly what you can reasonably afford each week and then start to make regular payments direct to the Council via their online payment system make absolutely sure you reach a figure that is affordable and sustainable to your circumstances as you must make the payments without fail every week.

 

With pen and paper at the ready contact your Council and ask:

 

1 - how much the Liability Order was for

2 - how much is still outstanding -

3 - also ask if the given amount includes any fee payable to the bailiff.

4 - what period of time the LO covers

5. - the date they passed it to the Bailiff

 

You are liable for the first visit fee £24 .50 and on his return another fee of £18 will be added to your account after that if no levy is successful then no further fees are due to the bailiff.

Pay only what you can afford...if that is only £5 per week then so be it. What is very important is that you pay that amount on the same day every week without fail, then you are seen to be willing to pay and not refusing to pay.

 

Get the info suggested and come back here to get help to write to all parties concerned.

Have you put in a claim for housing and council tax benefits or is the debt from before you went onto ESA?

 

Even if it was from before, Op is now potentially vulnerable, under the guidelines and should inform the Council, and bailiffs of this , as deductions from benefit are appropriate under those circumstances.

receiving both the debt is from before 2009, did have a payment plan but they still kept sending letters and bailliffs to the door and i do have receipts of payment, so as far as i am concerned they did not full fill the agreements

One question though I paid approx £382 direct to bailliff but have no receipt for that as it was over the phone he said he would send a receipt but never received one, would have to go through all bank statements to prove that it was paid to them

The above was originally written by Enid Blyton and Equita cottoned on it was a good ruse to frighten their "customers". As you know it has worked or you would not be here. Be aware that the letter will be full of may's and might's but as long as they have never been in your home they can do nothing. Reading some of your other posts have you done as suggested in Post 6 and find the exact details from the Council. Do you know how much the Bailiff has charged you to date? If not you should ask them for a breakdown of their fees.
