Hi guys got into arrears with my credit card and i owed vanquis £500 due to non payment charges was mounting up and the balance came to £660 so for the last 5 months ive being paying £33.00 a month to get this debt down. But just wanted to know could i claim my charges back.does anyone have any great advice for me.

Dear Sir/Madam,

I now understand that the regime of fees which you have been applying to my account in relation to late fees and over limit charges, are unlawful at Common Law, Statute and recent Consumer regulations.

 

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

 

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

 

I calculate that you have taken £XXXXX plus £XXX which you have charged me in interestlink3.gif for the sums which you have taken. Total £XXXXX

Additionally, you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you, or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account.

 

In addition to full payment of the sum mentioned above, I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable.

 

I require repayment in full of this money and removal of the default notice. If you do not comply fully within 14 days, I shall begin a claim against you for the full amount plus interest, plus my costs, without further notice.

Yes. I would also ask them to threat this as a formal complaint and ask them to forward you a copy of their formal Complaints Procedure. If they try and fob you off, you can then request that it gets passed higher up the pecking order.

How are you getting on here ?

I would have sent cc their legal team since we have some reported cases of them dragging their feet.

They have also been known to dispose of distressed accounts quickly when asked for refund of charges.

Just give them 14 days to refund or issue a claim.

i have just written to vanquis requesting my statements so i may total up my charges and claim them back. I sent payment for my statements and they wote back saying they didnt need payment to do this. So today i get a response saying they will refund me £120 and lower my interest rate but will charge me £25 a year for the pleasure.

 

I called up and said what is going on i just want my statements they said if i want statement it will cost £5 per statement so how can i prove that they owe me more charges than they are saying. I know i have had more than ten charges and i want my money back. Im very angry at them

Hang on, they didn't take payment for your SAR then offered a refund but didn't supply your SAR-is that right?
