ok back on topic for a bit.....

 

received this letter from Court today.....

 

before DISTRICT JUDGE JACKSON sitting at Leigh County Court, 22 Walmesley Road, Leigh, Greater Manchester, WN7 1YF.

 

Upon reading letters from both parties & reading the court file

 

IT IS ORDERED THAT

 

This matter shall be listed before District Judge Jackson on 26th March 2007 at 2:00pm at Leigh County Court, 22 Walmesley Road, Leigh with an estimated length of hearing of 2 hours

 

 

So there we go....

 

Things I take from this are

1) I don't need to fill in the N244 Amendments to Particulars of Claim

2) The court have accepted my 39 point letter as reasonable grounds for bringing the claim

3) It's been allocated to small claims track (it's what i asked for in the AQ and there's nothing here to the contrary - i'd like to find a way to confirm this though)

4) I'm quiote excited

5) Aardvark has agreed to attend for supoprt in the role of 'litigants friend'

Thank you very much - I can think of slightly 'greater' news though and that's a letter in the new year from Vodafone, with "not commercially viable, without liability remove default etc."

 

although there's a part of me that would like to nail this properly - we both present our arguments to the best of our ability and see what a judge decides. My worry with that though is if i fail on a procedural point or something....

ok what's the script on these bundles then?

 

so far I've submitted everything I have which is

 

1) copies of correspondence

2) AQ

3) my 39 point letter outlining my case which instelf refers to all the attachments etc.

 

the only other things i can think of as relevant are

 

i) copy of the DPA? I'm sure a claimant isn't required to furnish a court or defendant with a copy of the law?

ii) my credit file showing the defaults - but it's existence is not in doubt and accepted by vodafone, I don't really want to share the other data on there with wither V/F or the court?

what else should go in a bundle if needed and is there a correct procedure to send/share it?

yes but I disagree

 

1. Supply it anyway as you are going to supply it as evidence then the judge may want to have exact reference to the parts you are referring to

 

(this is really hard to type as I think ive knackered my key board by spilling nailvarish removver on it - and it not working properly knowgrrrr as if my typing wasnt bad enough)

 

2. Yes you most def going have to supply this - after it it is evidence of the event, if you cant show the judge the default then how can you get it removed - i had to take my file for the CCJ and the court issued that !!!

 

You blank our all the irrelevant info, anmd onl;y give the page withthe default on.
