Hello All !! new to this, but really could do with some help / advise.

 

My partner had a minor car accident back in March.... the police attended and asked her to produce her license. Some weeks before the accident, she had sent her license off to the DVLA for a change of address, and had not received it back at the time of the accident. So she called them to see where it was.

 

The DVLA told her they had not received her license in the post, and moreover, they did not have records of ever issuing one to her.

 

DVLA confirmed she passed her test in 2006, but they dont have records of her applying for, and then issuing the full license...... subsequently, her provisional which she passed on has expired.

 

Therefore, in October, her insurance company revoked her insurance, She's been to court and charged with driving without a license, 6 points and a fine, and DVLA are saying she has to retake her test.

 

On top of that, I am really concerned that the insurance company will come after us for the costs of her accident in March, as (According to DLVA), she was diving without a full license, and therefore, the insurance would be void !! :!:

 

She has never had an accident before, no speeding ticket, no producer....... so no-one has a copy of the license and she did not make a copy before sending it off to the DVLA!!! :!:

 

I am continuing to write letters of complaint to DVLA and been in touch with my MP on the matter, but it this doesn't work, where to i go for here ? Do i keep on fighting them, or give up, and accept the possibility of a) Paying for additional Test b) Paying £4k+ each year for insuring her (coz she now has 6 Points on her license) c) Possibly pay £10k+ for her accident :!:

 

We have family and friends (all who are professionals) who can vouch that they have psychically seen her license at some point over the past 4years, including me, but just because DVLA computer says "no", its could ruin us financially.

I'm afraid to say we rarely hear of successful challenges to the DVLA claiming you have no licence or it doesn't include the class of vehicle you are driving. Most common ones to disappear are motorbike category and HGV, even when that vehicle is what you do for a living!

 

Best action is never send the DVLA anything that you don't have a copy of, or better still, do it on-line and get your new one before you even release your old one out of your hand

There is always hope. But not where DVLA is concerned. They are ALWAYS right, especially when they are wrong!

 

One glimmer of hope. Have you ever had a copy of your licence taken for ID at a bank, building society, work, loan application or especially for insurance? It is well worth thinking hard and if so getting a copy of said licence back from them. Once you have a photocopy there is no better proof.

I am unsure of this but in order to get the full licence don't you need to make some sort of payment? If this can be demonstrated, i.e. cheque, debit card payment, then maybe you have a chance.

 

No. there is no payment to be made when you pass your test and convert your provisional licence into a full.

 

What DVLA are implying is that she passed her test but failed to surrender her provisional (plus pass certificate) to them within the 2 years that is allowed for such a conversion. After this, the "pass certificate" lapses and, effectively, you have lost your right to drive without taking a theory and practical test again.

 

Normally the examiner offers (and of course most people accept) to send your licence away for you at the end of your test. Didn't this happen for your partner? If so, the test centre may have a record of doing so.

Hello ALL, .... Thanks for your comments.

 

We have thought of every possible way to prove she was issued a licence..... but she has never used it for ID anywhere.

 

However, latest development....... one department in DVLA have sent us a letter 2 days ago which basically said

 

"Please return your licence to the DVLA so that her licence can be endourse"

 

NOW..Problem with this being,..... A) She got 6 points for driving without a Licence..... so how can she return it for endorsement ??

 

In addition, it also says "DVLA have therefore withdraw your right to Drive as of 29/11/10".......

 

SO, are the DVLA say she had the right to drive from passing her test up to and including 28/11/10...... and it THAT'S the case, how did she get 6 points for driving without a licence ?

 

In addition, this DVLA letter also stated her full driving licence number.... something which we never had before (well we worked out the first 13 charters, but could work out the rest...... and DVLA said in phone calls to them, that they couldnt trace her licence number with only 13 charters)...

 

Its a mess !!........ anyways, the appropriate reply letter as been sent to DVLA..... and also our MP has written to DVLA Chief Executive.

 

Sooooooooo may have good news soon ?

The driving license number sounds like a good start and hope that works out for you. But... do you think they could be referring to the provisional license used to pass the test with? If so it would make sense that they have revoked the right to drive, even on provisional and will have something to endorse.

its possible they're referring to her provisional licence number..... but still not had any reply from DVLA to my 16 November letter.

 

I'm clinging onto the fact that her provision should have expired 2years after passing her test.... and after which, she should have become unable to drive legally which should be well before 28-Nov-10....

 

Therefore, how could the DVLA state that she had a right to drive up to 28-November-10?

 

Anyways, letter received from Insurance Company now asking for a "copy of her full driving licence" to aid them with their enquirers into here accident"......OH JOY !! Think we all know what this means !! :!:
