How should I deal with possibly Statute Barred debts?...

Hi all, I have finally sat down and decided to deal with debts that have been hanging over me for years.

 

Having looked through my debts and all the collection letters that have piled up in a corner, there are a couple of big ones that I think I havent had any dealings with in the last 6 years. So I was thinking that they may be Statute Barred?

 

Is the best course of action to send a SAR letter to get copies of the contracts and statements for these debts and thus find out if there has ben any communication or payments in the last 6 years? Or is a CCA a better way to do this? I understand a SAR costs £10 and a CCA costs £1?

 

The main debts are:

£1200 with Capquest - originally Capital one Credit Card

£4000 with Equidebt - originally a co-operative student bank account overdraft

£3000 with Arrow Global Ltd - originally an MBNA credit card - This is the only one which appears on my CreditExpert Credit report

 

What is the best course of action for these?

 

 

Also I have a few smaller debts of around £100 each, would I be likely to recieve much discount on these if I offered full&final payment or would it be best to just set up a payment plan?

Yes subject access requests to the original creditors will no doubt provide info.

I would suggest also that you get copies of your credit files-this will give details of defaulted dates and more info.

Given that its going to cost a tenner a time and theres more than 1-you should make sure that you do a full sar and ask for everything including copies of any assignments etc.

Find out if there's charges on the Cap1 card, these are re-claimable.

A SAR is a request for all information held on you as a data subject, this is a request that must be complied with within 40 calendar days, the CCA is a legal request for a copy of your agreement and nothing else. A few may send statements but unlikely...

Who should I send SAR's to - I am recieving letters from Mackenzie Hall, Arrow Global Limited, Equidebt and Capquest for the various debts. Should I send the SAR to these collection agencies or to the original creditors?
