  1. are there any loopholes I can exploit - i.e. get them to send copies of all paperwork and the default notices to check for any mistakes? Just to be clear I am not trying to avoid paying, just to not have this ruin my credit for the next 5 years!
  2. Hi all, I stupidly used Quickquid for payday loans last year and defaulted on the payments. I am now being chased by ARC for the outstanding money and two defaults have been registered against me on callcredit. I am happy to pay the money back, I was wondering if there is any likelihood of being able to get the defaults removed? The two defaults are for £160 and £660. They were defaulted very quickly after they started: for the £660 (from callcredit report): Account opened 12/10/11 Account defaulted 09/01/12 for the £160: Account opened 07/09/2011 Account defaulted 12/12/2011 Both debts still appear on callcredit as owned by Quickquid, but when I spoke to quickquid they said the debt has been passed to ARC, the american at quickquid didnt seem to understand when I was asking if ARC own the debt now or if they are acting as agents for quickquid. As I understand it third party collectors are more likely to strike a deal to remove the defaults on full payment?? I will do anything possible to get the default notices removed as my credit record was just getting back on track when I did this, and this will now ruin my credit for the next 6 years (well just over 5 now). Any Advice?
  3. Who should I send SAR's to - I am recieving letters from Mackenzie Hall, Arrow Global Limited, Equidebt and Capquest for the various debts. Should I send the SAR to these collection agencies or to the original creditors? thanks
  4. is a SAR necessary or can I just do a CCA request for the information - i have read I can get copies of the statements with a CCA and this only costs £1 as opposed to £10? thanks!

  6. Hi all, I have finally sat down and decided to deal with debts that have been hanging over me for years. Having looked through my debts and all the collection letters that have piled up in a corner, there are a couple of big ones that I think I havent had any dealings with in the last 6 years. So I was thinking that they may be Statute Barred? Is the best course of action to send a SAR letter to get copies of the contracts and statements for these debts and thus find out if there has ben any communication or payments in the last 6 years? Or is a CCA a better way to do this? I understand a SAR costs £10 and a CCA costs £1? The main debts are: £1200 with Capquest - originally Capital one Credit Card £4000 with Equidebt - originally a co-operative student bank account overdraft £3000 with Arrow Global Ltd - originally an MBNA credit card - This is the only one which appears on my CreditExpert Credit report What is the best course of action for these? Also I have a few smaller debts of around £100 each, would I be likely to recieve much discount on these if I offered full&final payment or would it be best to just set up a payment plan? many thanks!!
  7. thanks for the advice! So if someone is chasing me for money and I dont remember when the debt began can I request the information about the debt from them? thanks!
  8. hi all, I have finally decided I need to sort out all the debts I have accrued over the years and have ignored. I basically racked up a load of credit card debts and unpaid overdrafts as a student and never replied to any of the post or anything - just buried my head in the sand. This was made possible by me moving addresses so much over the past 4 years that hardly any of the debt seems to have caught up with me. So I decided to get my experian report, expecting the debts to scare the hell out of me, but in fact it seems like there is hardly anything on there! I haver a letter in front of me I recieved the other day from "Capquest" debt recovery chasing me for £1200 debt they purchased from Capital One Bank, but there seems to be no mention of capital one on my credit report! I did have a capital one card years ago which I owed money on so Im sure the debt is real, I am just confused why it isnt on the report and if other debts are missing then how am I supposed to figure out how much I owe and who to??? I cant remember all the companies I owed money to and expect a lot of them have resold the debt to collection agencies. I would like to get an overview of my debt and work out a DMP with payplan or similar. Any idea's? Also my current vodafone contract isnt on there which I thought would be? thats one bill I have actually paid!! thanks for the help!
  9. what does it mean for an account to be unenforcable? why wouldnt they be abl to enforce it? And should I sign up to more than one credit agency then to discover who i owe what to? thanks
  10. hi all, I am looking for some help on how to deal with my debts. I built up a large amount of debt during my time at university. A couple of these creditors have caught up with me over the last few years, but most don't seem to have tracked me down and there has been no communication between us for years. I realise the stupidity of ignoring these debts and I would like to face up to my responsibilities and stop worrying everytime there is a knock on the door in case it is a bailiff. So I would like to start repaying these debts. I have been reading the site, looking at debt management plans etc but I would like to know the best way to go about this. The idea of a debt management plan sounds good as I work a lot and dont have much time to spend writing letters/making phone calls myself. So I would like some advice on where to start. Should I get my credit report first - as I honestly couldnt list all the companies I owe money to. If so then which credit agency should I sign up to for my credit report? And what do you guys think of debt management plans where a company would deal with everything for me and just take a single monthly payment? my friend has one and it seems a lot simpler than doing all the paperwork myself. Many thanks for any help!
  11. ok guys thanks for all the advice. I have spoken to logbook loans today and arranged to meet them tomorrow to set up the loan. But after going though the figures with their representative on the phone and reading all the horror stories on this site I have decided it would be stupid of me to do this and I am going to cancel the appointment. I will speak to my mother tomorrow and see if she can afford to lend me any more money. If not I will have to miss the holiday, that would be very frustrating but if I am being sensible, in reality I know this loan is a very bad idea. I wanted to borrow £650, and I would end up paying back £1271 over the course of a year, seeing as my finances are already a mess this would be a stupid idea. So thanks for all the warnings and here's hoping I can find some money elsewhere!!
