      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Having read a great dela on the banking thread, it seems to norm when getting charges refunded that they make an attempt to pay off debt collecotrs, oD's and the like.

The general concensus of opinion (with bank charges) is to point out to them the money is yours and you will spend as you see fit, and remind them you can always rerquest the money be paid to the court.

How this equates to your circumstances i would not cast in stone, but worth looking into.

The big thing here is to accpet as partial settlement and go for th erest, do nto get waylaid in your timetable and make sure they know you arer sticking to it.

I guess they wil cough the full amount eventually, but you ave to be firm with them.

This is your case not thiers and you work to what you want out of it provided you are right and accurate in what you are claiming for.

I love the smell of banks coughing up refunds first thing in the morning.

Firstly well done to you and everyone else who are going to fight GE,

 

I have just sent off a S.A.R - (Subject Access Request) to GE listing multiple account numbers which I have had over the years, and although some are now settled, some are with Cohens, Lewis and whoever the hell else they sell/pass these debts to. I have also in the past had letters from Aktiv Kapital relating to these,

 

It would appear GE sell the debt,(maybe after first using one or two collection comapnies of there own) to one company who then use another (or its still them, but just a different trading name) to collect, and possibly it goes to further companies even after that !!

 

I have found Lewis to be most persistent I always find the "all correspondance must be in writing" stops the calls quite well.

 

So, to this end I am going to go after GE first for charges, then and if I find any other third party have added fees, i will go for them also.

 

Out of interest, and in order to clarify which collection company is which, all credit and collection companies MUST be registered with and have a consumer credit liciense, on the licience apllication, they have to list every name they intend to trade under, unfortunately it doesnt look like this info is online YET, and you would have to do it by phone or letter, have a look at the OFT consumer credit licience website below:

It should be the card issuer......the name of the company thats on the statement.

thanks for all your posts- will take a look at tht website above as soon as my head stops pounding! my husband turned 30 yesterday so we had a bit of a big drinking session. i will leave a suitable recovery time!

I know what you mean - I have 3 at home. Sundays just seem to be the worst don't they? and then, you always have to go out somewhere in the afternoon and it is like mobilising a small army!!!

BAD NEWS - got my claim form and other documents sent back by the court with a letter saying 'your request for issue of the claim in the above case is returned because: the papers have been incorrectly completed ot you have used the incorrect claim form. i would therefore suggest that you seek legal advice to help you in the issuing of this claim'

 

i dont know what i've done wrong- am trying to make them produce missing statements. What should i do?

Thanks Martin. Certainly! The bried details of claim are: order under section 7 and section 15 (2) of the dpa 1998. do you want me to try and scan in the particulars of claim as they are quite lengthy?

First I would go through everything and check see if you can see anything.

Sounds like it could be something simple maybe even obvious.

Its more likely to be something other than that which you have copied and pasted.You know like your details/the defendants details dates etc etc
