I have responded to RW today!

 

I included in the letter a paragraph on the PPI claim with HFC and if they had been legally assigned the debt i would go after them for payment!

 

Let the games begin i suppose!

Hi

 

Has anybody requested and succesfully received a copy of the original application form?

 

I have a long standing issue with HFC and i want to be able to see a copy of the application form that i filled in before HFC told me they had approved the loan. The reason i want this is simple...i am almost sure the HFC assistant who dealt with me in store spiced up my earnings to ensure the loan was approved but i have no proof : (

 

Is there a standard letter i need to issue to obtain a copy because i am assume it wouldnt be as simple as 'hello HFC please provide me with a copy of the loan application forms'.

 

I have previously issued them a CCA request but that took them over a year to issue and when it did arrive it was only a very basic, crap copy of the loan amounts and a set of T&C's which looked to be copies of copies (i.e. extremely bad quality)

 

Any help would be gratefully received.

Hi

 

We had a further letter from HFC following a follow up letter telling them they were to deal with all PPI complaints in line with relevant guidelines despite the BBA legal bid. They gave us 2 pages of ****e as to why they would not deal with the case until the BBA case had been heard.

 

I must get round to writing a response. In any case in 2 weeks the 8 week period expires so i may well just wait and send to the FOS like you!

Hi guys

 

Has anyone ever dealt with Robinson Way / Horwich Farrelly?

 

RW had been chasing me for a HFC 'debt'. i wrote back to them asking for CA and supporting documentation like assignment notices etc. They never responded and now have these solicitors chasing me. Funnily enough the solicitors are based at exactly the same address as RW.

 

Id love to hear of any past experiences with how people have dealt / dispatched of these people?

How old is the debt ? when did you last make a payment towards it ? If you sent a letter to RW, and they have passed it to their solicitors (whether in house or not) then send them this by recorded delivery - http://www.consumeractiongroup.co.uk/forum/content.php?425-Letter-to-solicitors-threatening-legal-action-in-default-of-agreement-request - bear in mind that RW seem to have ignored your requests for a copy of your agreement, and if you refer to the OFT's guidelines, then they cannot continue to ignore that request/dispute.

Hi Martin

 

Nothing has happened since my last post. HFC wont decide on my claim until the Judicial Review has been completed.

 

I really must get around to submitting to the FOS for review. I am wondering if this will take longer than the actual decision in the review?

hey people

 

Just a quick update to say that i have finally gotten round to sending my complaint to the Ombudsman for their review.

 

I decided i wouldn't wait around for the Judicial Review result as HFC / Beneficial wanted me to. It will be interesting to see now if the ombudsman agrees that Beneficial mis-sold me the PPI Policy.

 

I guess ill have to wait a fair few months but i will post updates as and when they come through.

Quick update:

 

I have received a reply from the FOS simply to say that they have received my complaint forms safely. They will now assign it to the applicable party.

 

They warn that the amount of complaints on the PPI topic is immense.

 

Is there a set time limit for the FOS to decide on a complaint or is the PPI complaint on a as and when basis?

 

Is it worth writing to HFC / Beneficial Finance telling them i have formally complained just to keep a letter trail or shall i leave it simply to the FOS?

Hi Shane,

 

I have had an FOS complaint in against HFC since around October. The FOS responded in February stating that they had reviewed my submissions and those of HFC and found in my favour. They sent the decision notice to HFC who had 14 days to appeal. They failed to appeal or even acknowledge the decision so the case is now being referred to an adjudicator and this takes between 6 - 9 months for allocation.

 

I'm weighing up my options now whether to wait or take legal action.

Not likely. I've got a claim with the FOS which, in the initial investigation, found in my favour. However, it has now been referred to an adjudicator. If you have a claim in with the FOS then you can expect a turnaround of around 14 months.

 

HFC are basically corrupt. They know full well that their PPI policies were sold in a less than satisfactory manner and were rightly admonished with a million+ pound fine because of it. They were told to handle PPI complaints in a certain way but have continually refused to do so. I hope that they continue to fudge my own claim because nothing would give me greater satisfaction than to see them in court.
