Egg/ Lowell. Cant find the agreement! What next?

Hi. Lowell have written and said egg cant find the agreement as requested. They state that they will cease collection activity untill it turns up.

 

My question is:

 

Can they do this? IMHO they have not complied with the request and therefore the alleged agreement is unenforceable. Surely they cant hold this over me indefinately.

 

What should I do next?

 

Any help really appreciated

They won't hold it over you indefinitely-just up to 6 years! (six years from last payment)

 

While they can't locate an agreement, they cannot enforce it but should they find it, there is nothing stopping them attempting enforcement. It is only unenforceable while they cannot find the agreement.

Unfortunate but that's they way it is.

 

What should you do now? Sit back and enjoy the peace and quiet.

No!

 

They may write it off but you cannot force them.

 

If you wnat shot of it, you could offer them a Full and Final settlement. DCA's buy these debts for less (sometimes a lot less) than their book value so they may be amenable to get something rather than nothing

Rodders, keep at Lowell. I did and they closed the account AND removed the default from my CRFs.
