Hi

 

I keep getting repeat letters from a bailiff and recover agent called Philips. I know they are working on behalf of a company called Zinc Group.

Now I initially got a letter from Zinc asking for payment for a company I dont know . So I asked for more details and never heard anything .I now lately I have been getting letters from Philips . I did contact them via email asking them to tell me what the debt was for as Zinc had not got back to me. But Philips are ignoring me . I have also sent letters but now the letter is a previsit notice . I have had no legal letters apart from these.

 

whats my next step

Have you had a CCJ entered against you for this debt?

 

If not ignore the rubbish about the bailifs as they can not be used without a court order - unless its for a fine . - they are just trying to frighten you.

 

Best thing to do is ignore the letters or send a CCA request - personaly i would ignore it - if they have a hand to show let them show it.

If anyone from foolish philips turns up, just hand them that and shut the door.

They are only acting in the DCA role, but will have undoubtedley been using their 'Bailiff' letterheaded papers to intimidate you.?

There were several of those letters received this week, I actually got one myself, it is the third one from Philips and they say it for a Goldfish account. I have never had a Goldfish account in my life, all I have is the rejection letter from when I applied years ago.

 

I have chosen to ignore the letter, as you say, they ignore any replies they get. They will look fairly silly taking action on that! Mine mentioned the Zinc group and I have never heard of them.

I assume that Philips are the new Poodle being used these days as they contacted me on behalf of Lowell Portfolio 1 Ltd and yes they do use thier full headed paper:

Philips Specialist Bailiff & Recovery Agents (Like the way they put "Specialist Bailiff" first :lol:)

I haven't heard any thing from them since late Aug after (Amongst other things) giving them 7 days to supply thier complaints procedure, wonder why they haven't complied :!:

I have never had a Goldfish account in my life, all I have is the rejection letter from when I applied years ago.

 

Blimey HS you must have been in dire straits to be sent a rejection letter, I remember when you couldn't walk more than 5 steps without someone trying to give you plastic and money!

 

Revenant you MUST lodge a formal complaint to the OFT&TS via consumer direct.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Morning BB

 

Lowell PF1 have just reared thier ugly head via Meritforce/Mackhall for a disputed account that BCW returned in June

 

I explained the situation to Meritforce and that got ignored, recieved a text from Mackhall so they now have until next Monday to comply with my request for thier Complaints Procedure etc, should they fail to comply then I will complain on both accounts in one go

 

In the mean time Mackhall have sent me a "Goodwill" offer of 50% off so we know what that means:lol:

Probably after I had taken out just about everyone you could get and fancied a 'goldfish' one - liked the sound of its name:lol: been doing the old move the balance around for no interest thing and I guess I got sussed.

ukmarc I have a template letter for when you might propose to your first love? What template letter are you asking for, what is it relevant to, and do you have your own thread?

Is this a template for a CCA request? Failure to provide, statute barred, no debt acknoweledged/????????????????????

The letter I have been asked to send is to tell the debt agency that they have 12 days in which to show proof that I owe money and to mention the Consumer Credit act 1974 sections 77-78. and to advise them that if they do dont get in touch or show proof that any further threats will be passed on to the relevent bodies

Letter requesting a copy of your agreement - It should be sent with a £1 postal order and sent recorded/guaranteed delivery - It should be sent to whoever OWNS the debt/is demanding payment. The timescale for providing this is 12+2 WORKING DAYS. If it is not sent within this timescale they are in default of your request.

 

Please ammend paragragh 1 to suit. ie s77 Fixed sum credit such as loans, s78 Running account credit such as credit cards & catalogues and s79 Hire agreements.
