Last two defaults to be removed - made up partly of PPI

Hi all,

Most of the defaults on my credit history are now gone. Im down to the last two and i know these two are partly made up of PPI premiums.

 

However, the defaults have been sold from barclays to Lowells. So I was wondering,

 

defaults dont get sold , the A/C does, have you had notification it has been sold?

 

- Can lowells put defaults on my credit report, even though the original agreement (2004) was with barclays?

 

are you sure this is what happened?, i would suspect the A/C has been sold, if so the existing defaults, will be renamed to lowells.

 

- Do lowells need to provide a signed copy of the agreement to me before the debt is enforceable (i recall some recent court case stating that creditors can basically say 'he signed something like this' and produce an unsigned copy of some terms and that was good enough?)

 

yes they do

 

- As the debts are made up partially of PPI premiums, are they unenforceable/do I have a way out?

 

no - that will not make it un-en neither will unlawful charges - however, you cam reclaim both.

if you made no NEW agreement with lowells then its time to hit the cra's

 

you can only be defaulted ONCE for the same debt.

 

unless these are not defaults but are late payments markers.

have you approached lowells with the letters from barclays agreeing to remove their defaults?
