How likely are bailiffs to arrive at my doorstep over a £138 debt?

Hey there,

 

Quick question, does anyone know for certain if there is a minimum debt needed for bailifs to be employed to recover it. I owe C.A.R.S. £138 over a Virgin Mobile debt I couldn't pay at the time. Given that I am currently unemployed I offered them a token payment which they refused and are now making threats of legal action, i.e. court and bailiffs. It seems unrealistic to me that they would pay hundreds if not thousands to solicitors and to a bailiff company over £138!!

 

Am I being nieve, are they likely to take legal action?

 

Any help would be much appreciated.

There is in theory, I believe no minimum amount for a Court Summons, however, they are probably making all the noises, but are not prepared to carry out their threats.

 

Firstly they would have to issue a Summons and obtain a CCJ

That would make a payment plan which you would have to break then they could issue a Warrent of Execution and this would be where Bailiffs would come into the picture.

 

I would write to them and inform them that you will pay a set amount on the 28th of each month (make sure it will be a comfortable amount to keep up). Start making the payments, even when they refuse and there is no way they will take you to Court.

 

It is for you to decide how much you can pay them, and not the other way round.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

From all my years experience on here, I've not seen anyone being taken to court for an amount under £200.

 

No chance of them sending bailiffs. They would have to go to court and get a CCJ againt you, and you wold have to default on that before bailiffs would be involved.

 

As you are unemployed, then a token payment of £1 a month is fine. This is all a judge would make you pay anyway, due to your financial circumstances.
