yes they are.....there is nothing in legislation that stipulates that you must put their name on it......send it back stating that you believe that this is a stalling tactic and the days have already started ticking.....also kindly inform them that any further stalling will result in you contacting the information commissioner to report them

of course they can....they're just being pedantic. I must have sent 50 in exactly the same way and have never had a problem. It's exactly the same as a cheque...you can't cash them anyway they have to go into a bank account. They have provided payment in the form of £10 so it is valid.

forget the term postal order and think of it as a blank cheque.....you can put a blank cheque into your bank account in the same way as any company can. These postal orders are exactly that....they are a blank cheque with guaranteed payment and would take exactly the same period of time to clear as a normal cheque into your account.....They can't be cashed, that is not there purpose. They are an absolute godsend for those of us who can't get a cheque book. I have had everybody from Abbey to Nat West, Barclays to loads of other companies put these in their accounts without any problems whatsoever. I have also had several blank postal orders sent to me which I have in turn had no problem in putting into my bank account and then withdrawing when the clearance period has elapsed.

I'm a little confused and it may be possible I am reading this the wrong way and I am happy to be educated. I understand there is no difference between a postal order and a cheque in how they are cashed. My point was is if I for example send a postal order or indeed a cheque that is not payable to any one, and therefore can not be cashed, how then in turn can the service to which is requested be provided ?

If I was to send you a blank crossed postal order now and you were to put it in your account, you would then have the cash available in the normal way (ie after the normal clearance period for your bank), it is literally as simple as that. It doesn't need to be payable to anyone at all.....if it's blank ANYONE can put it in their account and it will be available after it has cleared. As I said earlier I think I have dealt with pretty much every major financial institution in this country in this way and have never had a problem with them.

I see your point in that it could be paid into any account, however if in this instance you were too send a postal order to xyz company asking for data, the fact that you have decided to not make it payable to any one could allow xyz company to claim that they can't proceed with your request as its not payable to anyone..

Rubbish, the legislation states that you have to pay them....it doesn't say that you have to make any payment payable to them specifically or in a specific manner and as such they would be failing to meet their obligation.....the simple fact that I have done this dozens of times and never had a problem is enough to suggest to me that anybody raising this as an issue is stalling and have something to hide.

I do not understand why have to be "postal order", why cannot we use personal cheque instead? if is a requirement by law? which law? Can some one please explain this?
The reason for using a Postal Order, is to deny the enemy any more Data or information than they need to process your Data Subject Access Request or CCA Request (as applicable).

 

A Postal Order does not require your Signature, so there is no risk of a clever DCA or banker lifting your Signature to make it appear somewhere else, like on an crabby copy of an Agreement for example (that hides any cutting and pasting that has gone on). :rolleyes:

 

Likewise, a Postal Order does not provide your bank Account details to a cunning DCA who may try to use that against you in some way.

 

It's one less piece of your life's jigsaw that you can avoid letting them have by using a Postal Order.

 

I would always make the Postal Order out to the Company concerned, and then cross it "AC Payee Only", so that it must be paid into a bank Account with the same name.

 

Provided you retain the Postal Order's purchase receipt, I gather that you can still cash it in, should they return it to you for any reason, even if you have entered their name and crossed it. Obviously, only you would have the receipt, so that is not an option for anyone else to do.

However, when we send the "subject access request", we will have to sign it on letter, they could still steal this signature if they want to, am I right?
