Hi I wonder if you could help. what does "Hire purchase agreement NOT regulated by consumer Credit Act 1974 mean. The reason I ask is a friend of mine had two vans they paid

£8517.14 on 24.07.07 they paid acceptance fee of £100

£863.75 x 24

 

No payments were missed until the original company were bought by another one. When they tried to carry on paying they were told too late. A week later some men drove from the opposite side right into the path of the driver of the van on there Private Road (with signs saying so) They stole the keys dragged him out and took the van. They took equipment personal property, Sat NAV and Sat tracking system. The vehicle was tracked for weeks. The Police said it was nothing to do with them.

 

The other van they have hidden away until i can figure out what to do as i cannot believe this is right. The finance company have rang and called in on a daily basis saying they have sold one van and want the other.

 

Not only did they take the van without asking with no paperwork nothing but they will not say how much they sold it for but they kept the property in the van.

 

Any ideas as this finance thug oops, person is getting quite nasty.

I know that agreements NOT regulated by the CCA 1974 are known as "Unregulated Agreements" and used to be that way because they were for over £25K. I'm sure the financial limits part got lifted in the 2006 amendments tho :confused:

 

There just has to be a way of sorting this out, it all seems excessively unwholesome!!! :mad:

 

Are you sure these agreements were unregulated??

I asked the nasty man for a copy of the agreement and he sent me 1 photocopied part showing the figures and at the top it says Hermes Group Ltd then not regulated.

 

They had actually paid off £29,000 off the vans. Maths is not my strong point.

Even if the agreements aren't regulated by the CCA 1974, I'm sure you can still raise complaints about the way the company has treated the consumer with the FSA, FLA, OFT and Trading Standards!

 

Would you be able to post up a few more details? Like what exactly happened when the first company went into admin and how it ended up that your friend was unable to make payments at that time, are the new company actually a subsidiary of the old company or was the debt sold??

 

If I were you I'd find out about this company of thugs and check who they are regulated by and then report their disgusting behaviour straight to the powers that be!!! :mad:

So Hermes Leasing are up to their old tricks again. As stated above, they're part of the singer friedlander group, which is part of an icelandic bank which got into difficulties (putting it mildly) last year. Singer runs out of glasgow. The whole organisation is staffed by totally inept people. I mentioned last year a problem with Hermes, and their repo agent in the south, S L Premier Vehicles Ltd. One can only hope that the administrator pulls the plug on this pile of sh*t, and that the office of fair trading get their teeth into S L Premier Vehicles of Cricklade!
