Has any one lost a court case?

Just wondering how many people have gone to court and lost a case against the back.

 

If so what reasons were give?

I don't know for sure, but from the discussion I heard on Radio 4 today, no cases have actually made it to court. All have been settled before then.

there was 1 case go to court i cant remmber who it was but they lost because of some problems with the case

I beleive it was someone before this site had the step by step guides and support and it was on a technicality of some sort. I think the info is in the thread - Courts still ordering stays

If for some reason someone has been to court and lost for not following the correct proceedures would they be able to resubmit their claim to the bank/ courts or would that be the end of the matter?

I'm not sure but I beleive in criminal law you can only be tried for something once - so assume that applies. Otherwise every time someone lost a case they would just be re submitting it. Don't know about appeals in the county court either.

Someone lost vs Natwest, but it was ages ago now and Natwest have (to my knowledge) paid up every claim since. There were technicalities involved I think and the claimant in question was represented by a solicitor. Details have been linked before by BF, but I can't find the thread at the mo.

Hi sorry to butt in on your thread but i know of a couple of cases with the Bank of Scotland that have ended up in court but the judge has given them i think about 14days to settle, i know the law is different there but even so still very scary for the people involved..

I don't know about anyone else that has thought about going down this road but I am nervous. I have sent off my first letter requesting copies of my account and so far am looking at a 5 figure amount. Feeling quite scared - is this normal

5 figure is rather a lot usually county courts limit is 5 grand (i think ) you might be better off to do it in yearly amounts it'll probally take a bit of time but it'll be worth it in the end

hi i've just had back my final rejection letter after sending off my LBA letter. I'm feeling pretty nervous myself as i have reached the point of no return.

Thats not the case at all, there is no limit to the amount you can claim at the county court. The small claims track ceiling is set at 5k, claims above that go into the fast track or the multi - track. This has some dis-advantages, but also some advantages too.

 

Margosweeney - you need to do some research and take in all the information on this site and you'll feel more sure of yourself. You WILL get your money back, but you MUST know what you are doing first. Start off with the FAQ's and the step by step instructions.

That is why the banks always string it out because they hope you'll pull out due to nerves..... i'm sure the 130 people who have won had those same feelings at some stage, stay with it and just think of all the lovely shopping you'll be able to do when you get your money back.

Margosweeney,don't be frightened by this.All the help you need is here.You will get letters trying to put you off claiming.Scare tactics to make you back down.I personally have'nt had any problems chatting or writing to bank staff.You get the standard 'Go Away ' letter,but you must claim what is rightfully yours.We have all been duped into paying excessive charges for years by the banks.They knew that the charges were Unlawful.Now that they have been caught with their hands in our accounts,we want it back.People have lost homes and families through bad banking practices.They have'nt appeared in court yet as full disclosure of their true costs would have to be presented.It's like the Coca Cola formula.Well hidden from everybody.The true cost is pence,all done by a computer.Your amongst friends here.But you will need to be prepared if it does go to court.Probably won't but could happen.Everything you need for that is here also.If the calim is too much for small claims,you may be able to split it.Let us know the details when you know yourself.Someone here can help.

they will not go into court to defend because they would have to disclose exactly how much it cost's them to to refuse a d/d, s/o ect ect,

because by law they are only allowed to recover their ACTUAL COST'S

then the flood gate's would realy open for claim's

Hang in there - it's all a bit scary tho I admit. Best thing is to have a read through the successes threads to boost your confidence & give u the will to go on - Spend as much time as you can reading the FAQ's as there's posts on what to expect at each stage - It really won't seem quite as scary then I promise!

 

Infact, you may start to get a bit excited instead!
