I was starting my claim when all the court stays were put in place.

 

Is it still possible to claim, if so, great!

 

For this year I have noticed Abbey started charging for US$ transactions where they did not before and have not notified me of that either.

 

They are also in the process of changing Visa Electron cards to some other type of Visa. The electron card was always free for transactions overseas and I would use it for ebay and paypal and direct transactions in US$.

NatWest: £4529 Claimed 10/05/06 - Paid in full 1/08/06

Halifax: £1150 lba 18/05/06 - Paid in full 07/06/06

Natwest CC: £420 Initial letter 25/07/06 - Paid in full 08/06

Woolwich: £1100 Paid in full 28/2/07 + Default removed

NatWest Pt 2: £1700 Claimed 10/05/06 - Paid in full 7/2/07 + Defaults removed

 

Current Claims:

Abbey Pt 2: £2300 + adverse credit removal claimed 23/03/07

Alliance & Leicester: £1421 + adverse credit removal claimed 23/03/07

 

Refunds pending:

Capital Bank: Swift Advances: Halifax

 

Son's Refunds pending:

Abbey: HSBC

I have a claim that started in 2007, I have just received a letter from the court saying the stay has been lifted and the case will be heard in Aug this year. Is this still the same as before, IE they come to an agreement before the date or are they actually appearing in court now?

 

The amount has risen by over £1,000 since then as they have been charging every month since then.

No...it needs a slightly different argument.

 

In your POC what were your arguments for a refund insofar as was it based on the old Reg 6 and Penalty argument?

It is as per the original argument that was being used in 2007. I was going to get round to sorting this out when I received a letter saying the stay had been lifted.

 

Where do I go from here, I presume Cahoot will gladly go to court on the original argument as they will win. How do I get this changed now the hearing date has been set.

It is ages since I checked in here and read up on what's been happening. I seem to have missed a few things... so I'll be doing some more reading soon. In the meantime, yes, I have an ongoing action against Abbey/Santander, which was last heard at the Leeds Mercantile Court, when it was stayed pending the Test Case (30th August 2007). I have heard nothing from the courts since then. My thread is here;

i have charges on a loan which was with cahoot, which i believe are now abbey santander, i started the process well before the court ruling and it was put on hold awaiting the ruling, they then informed me that was the end of my claim as the courts rules int he bank favor, any advice would be appreciated as to whether i can start my reclaim again and how to go about differently would be fantastic ,many thanks
