      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well I've just read GSM guys thread. He basically got his list of charges and started his claim - then ordered 6 years of statements only to find they'd missed about a grands worth off. Just been on the phone rapid and ordered mine. Emma(W03836) has charged me the tenner (told her I would just add this to my claim - she laughed) and says they will be with me with 5-7 days - we'll see. If they have done this - and I wouldn't be surprised with this outfit, are these my options?;

 

*Try and add them at the victory stage (thier duplicity)

*Ammend current claim and pay fee - and add it to the claim (thier duplicity)

*Start claim number 2 immediately - with no fear of them being merged (falls well below threshold)

*Start claim number 2 after victory.

 

Any thoughts?,

I think no 2 - amend claim. Then you`ll get it all over and done with. 2nd choice would be no 1 - negotiate after victory and if you don`t get anywhere go for no 4 - new claim. If you gp for no 3 - new claim now, you`ll have to pay more up front than if you just amend your claim. I bet you`re a happy bunny anyway!

While reading your thread and on seeing that your gender had been reclassified by Barclays Legal Dept I have just checked their defence they sent me and low and behold in Para 3 (i need to put my high heels on for this) The charges constitute payments the Claimant agreed to make by reason of the terms and conditions of HER account ect. And the same about the shedule of charges, That they have had twice from me and once from the court.

Just makes me think their defence is a standard print out and they dont even bother looking at whats being supplied to them.

 

Anyway going to Bluewater to see if i can get a nice blue two piece12_3_120.gif for court having trouble finding sumthing to fit (6ft and 18 stone, stubble, going bald and a bad case of flatulence) so im quite looking forward to meeting mr Ruffead.

Oh these people.

 

Recieved generic response regarding my complaint that we all get when we submit an SAR, even though I was told I'd recieve them within 5-7 days. I feel like my claim has gone back to the beginning!

 

"May we assure you that your comments are extremely important to us, and we will respond to your complaint as quickly as we can"....

 

Oh p*ss off.

 

Just called them (on hold for 10 minutes whilst the operator frenetically dialled around customer care and litigation no doubt)

 

I asked if they planned to stick to thier deadline of November 10th, as if that was the case, I would be forced to write to the courts and inform them Barclays was witholding information that could be potentially used as evidence.

 

The girl said it is now being treated as urgent but wouldn't give a timescale - I pushed for one and was told 7 working days.

 

Again I wait. Barclays have 8 days left to submit AQ:D

Consider yourself lucky Thailand their 'final response' to my CCA section 78 request is tough luck we sent a copy of the application form so you dont need the credit agreement.

 

My NOT final response is to report them to the Financial services ombudsman and suspend all payments in the hope they will try and take it to court to save me having to fill out yet another court form:D

Thats funny, thats exactly what I want Cap One to do to me. I will treat them with all the contempt and transparency that the banks do me. If they take me to court they can expect £1 monthly installments starting 2008 (after I've successfully reclaimed my charges first of course!):lol:

i think thats very naughty of the woolwich and i think i is an offence of the DPA to supply a printout with a legend/key/thingy (the word totally eludes me) to be able to understand it.
