      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Your 3 dongle may tell you how much you use... I used to sell t-mobile dongles and they had a section that kept track of how much you downloaded.

£5.99 with plusnet gives you 10 gig allowance. (you can download 10 gigabites of data each month)

 

£10 with three gives you 1 gig allowance. (you can download 1 gigabite of data each month)

 

 

Plusnet is up to 8 meg speed (estamated 4 meg speed)

 

3 dongle is up to 3.6 meg speed (last year in the center of london, got around 1 meg speed acording to a review I read. (t-mobile got consistantly over 1 meg speed... I used to use this fact for comparison when I was selling the t-mobile dongle:lol:) )

Hi

 

Will you post how you get on? I'm interested because I'm going to switch my dad over to Plusnet when his Talktalk contract runs out in Feb. He is paying a fortune - don't think he knew what he was doing when he signed up!

If he's paying 2 much with talktalk there is something wrong... they are very cheep! If he is thinking of swapping, most DSL broadband need a BT line. (this is where I think Allwood's problems are stemming from) Now, BT have a "Socially responsible" package called BT Basic, its about £12 - £13 per quarter for line rental (and you get £12 - £13 of calls included in the package!) so get him to check that out. That along side PlusNet would be a cheep package!

 

 

 

hi Allwood is plusnet ok from my point of view no they are not ok but thats for me, im whats called a heavy user,

 

if ur into loads of downloads, streaming videos and gameing then u need to be carefull what plusnet package u get as they control the speed of ur line to alot of sites that they have decided on no mater what speed ur line can handle, so make sure u choose the right package for ur needs, ask questions of there suppost and sales staff, check out all the links on the product page. ask bob questionson here, im sure he wont mind helping...

 

if u dont get it right u could end up paying for a package u cant use, mind u im sure plusnet let u change packages part way through a contract..??

Gaming uses very little download usage and doesn't need a fast speed broadband. You need a fast ping over a wide bandwith. I have about half meg connection due to where I live but I have a reasonable ping, and I've never had a problem with online gaming.

 

 

 

Talk Talk dreadful provider...they will try and screw £70 from poor unsuspected people regardless whether their contract has ended with them.

 

I still have no broadband and I dial 150 and unfortunately I am still with talktalk.

 

As mentioned above, I was told by Plusnet that I would be connected by 16 February this would have been 1 month after placing the order with them. Cancelled my DD for talk talk and after the time scale had passed I got a message from plusnet that my conection would be now 30 December.

 

I am thinking of not using any broadband now as I feel they are like banks all they want is your money and not provide anything for it.

 

Not sure if I can get out of my contract with plusnet as after the conversation I had with them last week I got several messages that my order was being processes, I feel plusnet has broken this contract by initially telling me that I would be connected within 3 weeks and then on 16 December and now it is 30 December...what are these people playing at. I received their quipment about 2 weeks ago.... during one of my conversations with plusnet I was told that I would received their quipment about 2 day before connections. It seems that these people do not know what they are talking about :x:confused:

Right, your phone line is with talktalk, this is going to cause you some problems. I'm sure Bob will have some solutions for you.

All I can say is I had no problems going to Plusnet - everything connected within 5 working days.

 

I am dreading switching my dad from Talk Talk to Plusnet next year though ........

 

Start a thread when the time comes. The problem with moving from talktalk to another provider is that you lose broadband for about 10 - 15 days whilst you transfer to BT and get new broadband provided... you still got your 3 dongle? Maybe a PAYG Sim in that would tide him over! ;)
