cabot, how much info do i need to give?

Won t the judge just throw their case out of court when they take someone to court for non-payment when theirs no CCA to back their claim ? surely this must be getting to a situation where thousands of folk are getting the backing of the courts and ruling against the likes of cabot?

 

The courts SHOULD throw the case straight out, in fact it shouldn't get near a court in the first place. The problem is, what should happen and what does happen are often not the same thing.

 

Some judges don't have enough knowledge of consumer law, others are swayed by the lies told by the likes of Crapbot, and some, like the one in the recent BeauBrummie farce, are just as bent as a nine bob note and would rule in favour of big business if the CCA was a copy of the Beano.

 

Also when I first approached the CAB some 5 yrs ago regarding my problem, not once did the person helping me ever ask me or cabot to supply a CCA....is this a new thing out or something that has just be found out by the wise people of this board?

 

The CAB will not mention enforceability if you consult them now, never mind five years ago. To them, anyone in "high" finance always has their figures correct to the nearest farthing, and you, the lowly debtor, must pay what you "owe" even if it means selling all of your body organs to the highest bidder.

 

CAB have their uses, and many of their volunteers are genuine and honest, but cases such as yours will get better advice from CAG.

 

CAG didn't invent the Consumer Credit Act 1974, it has always been there, but few people have ever been informed of its consequences until this site filled the gap.

It's worth pointing out, that even those who get a district judge who ignores the law, if they persevere and take it to appeal, must win eventually. The precedent law goes all the way to the House of Lords.

 

DCAs prey on people's ignorance, and sometimes take it to court in the hope that it will be undefended, or that the victim doesn't know enough to make them prove the case. And I wouldn't mind betting that they win quite a few because of that. It's jut a percentage game to them :(

Hi All,

 

Done some digging today, old paperwork out the loft regarding this problem, found something Id like your opinion on, when I went to the CAB for advice, the lady handling my case sent a letter for infomation about the amount I am suppose to owe them, Cabot sent a request for infomation reply, (sorry I don t have a scanner) it looks like a bog standard form that they ve created and printed off, this has no info regarding myself other than my name and my parents address, not the one I lived in when I took the card out, also theres a box on the bottom of the form which heads....Any comments you may have or infomation you require?.....(cabot have printed in this section) Copy of application form not available as we are not the originators of this account.

 

Also they quite kindly sent me a budget planner today for me to fill out and return or call one of their helpful phone assistants......think I might just give that offer a miss!!!!!

If you've beem piddling about with them since 2005 what do you think the chances are of them having paperwork?

 

and GOOD because it IS a game, so be prepared for a lot of gouging attempts whilst the refs not looking:grin:.
