As i don't have much time to type i'll keep it short.

 

I used a DCA website to make a payment online. The guy I called just now said there is no record of payment. Indeed no money was taken from my bank.

 

I have no payment on me now til the end of the month, but he said it will be left open for legal action.

 

I called back and stated the letter I got today saying i defaulted on payment was dated 8/8/06 and i paid online on 05/08/06. Surely this is not my fault if their system does not work?

 

I asked to speak to someone senior and he said noone was about to take the call but someone would call me in about 10mins.

 

Any advice?????

 

 

p.s: This is nothing to do with the two things in my sig.

The bank account was defaulted and passed on to Moorcroft.

 

I offered on the phone to clear my arrears at the end of the month as i have no money on me to pay it til the end of the month. He said it is not acceptable and that it will be left open to legal action.

 

No phone call just yet...

Tell them to take you to court as you can not afford what you are paying them anyway, and you have been advised that a Judge will fix a payment level that I can afford.

And if you need the monthly payment amount reducing tell them the new amount on the phone if they do not like it, tell them to take you to court as that is what they are getting.

But surely court will mark my record??? I don't want a CCJ or anything. :(

 

I'm leaving the country to live abroad in October so need to get it cleared by then anyway.

 

Basically because their online payment system is bodged up, they put the blame on me saying I haven't paid and now I don't have the money to pay it. :(

 

Is the above what you put the answer? I don't want to bring court on unless absolutely necessary :(

Can I do that? Offer them a reduced amount? They keep saying I have to make a payment and that is that. I can't pay now this second but they expect me to.

 

The guy on the phone was a real arsehole too, not budging an inch.

 

If they don't call in next 5 mins shall I call them back saying you did not return my call?

Cool, so if I say now:

 

"I would like to reduce my monthly payment to something more affordable. I would like to pay £X."

 

await the answer. If they say no, then I say "then take me to court"?

 

Will it mark my record though?

 

What about paying up now on the phone? I can't :(

tell them you refuse to pay by card anymore and will pay by chq/post office in fact tell them you want a giro payment book, I would be surprised if they ring back on time.

Moorcroft will renegotiate your payments with you. I was paying £400 a month (I KNOW) and they reduced it to £70 a month when I called them.

 

The online payment system is crap _ I always got into problems with them when the payment I put through didnt work. They sent me a payments book in the end.

£70 i have people who owe £20k with them and are paying £20 a month and have loads of spare money.

Good news. I called them back and explained what happened. The supervisor was the one who picked up anyway (so he said).

 

He said he'll send a post office book out and reset the date I have to pay each month so he's set it to september. I just have to make a reduced payment in the next 7 days to keep it sweet.
