i am about to start my claim with capital one, ive only had account just over 2 years and they have taken £640 in charges to date in overlimit fees charged and late payment fees charged, over the last 5 months ive been paying them at least £35 - £40pm but they still charge me as the date they request the payment i send through internet banking which takes upto 3 days to clear in there accaount hence putting me over the limit, its been a constant battle with capital one, in january my ballance was over £400 due to charges, so i had to find £221 to pay them in feb 06 to stop the default they threatened me with.

i already have recieved my statements since opening the account, so now i take it i should send the preliminary letter, i have also done the list of charges on one of your helpful spreadsheets, but please can someone tell me - i dont include the 8% interest at this time do i? just a list of charges and dates.

is this correct or is it different claiming on credit cards to what its is claiming bank charges

id appreciate any advice

ok so ive gone through the 14 days now since i sent lba letter to capital one and i have recieved nothing back as yet, can anyone advise wheter i take this to the courts now or can i send a final letter alond with copy of last lba letter giving another final 14 days?

had a letter from them today offering to refund my account with £256. my balance is at £200, and they have offered to reduce the fees in line with their competitors of £12 rather than £20, and have backdated the charges, so are paying me back the £8 difference, i have decided to except this as my account will stay open.;)

Firstly its accept not except. Secondly you accept £256 of £650???. Crazy!. Your account will stay open so you can spend the £200 upto the limit. Why not just claim and have £450 in your pocket instead?. Twice as much with none of the debt.

I would say that by posting on a public forum you leave yourself open to others opinions and im sure that it is good to get others opinions from people trying to help. However it is your decision. However I agree it is not polite to pick up on peoples typos.

Hang on I corrected Hairybears wording as it it wasn't just a typo or a spelling mistake as you both claim, he had used a word that meant something different to what he was intending and as a result what he was saying was not totally clear.

 

Even after being corrected he still made the same error......

 

Kind of explains where the half brained logic behind his decision to ACCEPT the offer came from, and as Ozzywizard says why post on a forum for opinion if you don't want to listen to any that disagree with your own view. Its probably lucky it didn't get to the filing a claim stage as the court staff may of needed a translator for your form.

for gary im also a she not a he, and theres really no need to state i will need a translator to fill out my form, for 1 im a very busy lady with a career, so when i type to this forum i do so from work and dont really have time to check my mistakes, you obviously have time on your plate to have to pick up on other peoples mistakes..

We can all find faults with each other, typo's happen when people are quickly posting on a forum in the little spare time they have.

It doesnt really matter, it is acceptable and not noticed by many. Even less actually pick on it.

 

Now lets use this forum for what it is intended and leave out the insults.

We should be a team with the same cause and the only ones we wanna be insulting is the ones who have or try to take our money without legal ground.
