ps they r lying b*****ds coz the visited for all 7 at the same time even have the bits of paper for them that the bailiff stuck through the door and he gave me 3 bailiffs names that dealt with the case and none off them match up to any name of a bailiff that came to see me .i even remember the nice bailiffs whole name and according to them he wasn't one on their list........had a right good laugh at this

when they do a levy they can only charge a walking possession fee and a levy fee they are not allowed to add any charges for anything else on the day of a levy (sch5 fee should not be there)

same for van fee cant charge van fee levy fee same day

 

your notice of goods & inventory should be done on 1 walking possession agreement (if i remember correctly your bailiff done this )

therefore you should have 1 w.poss fee £11

your levy fee the bailiff should have added all liability orders together and charged 1 levy fee

broken down like this

12½ per cent. on the first £100 of the sum due

4 per cent. on the next £400

2½ per cent. on the next £1,500,

1 per cent. on the next £8,000

 

actually the levy % will be a bit less i used new %

the first van fee was added the first time a bailiff came to my house which was on the 12.01.2006 not 26.10.05

 

the other thing is if i add the liablity amounts together they come to exactly £2934.71

 

first visit according to my paperwork amount £4047.71

 

which is £1113

 

second visit according to my paperwork amount £4047.71 on the 17.02.06 now i have added the charges together up until the second visit on 17.02.06 and according to letter received today the charges to that date will have been £393.00 and that includes the unlawful van fee on the 12.01.06

i get the levy alone to £75.34 not £240.00 like they have charged

date at 26.04.06 balance now £287.02

 

the bailiffs charges until that date left £70.02

but if you dont take off the sch 5 at 24.50 it does leave £94.52

the same for second account

 

however for the 3rd account it doest add up

 

original liabilty £340.36

amount outstanding on 26.04.06 is £543.36 take away charges added untill that date leaves £435.86

Nooooooo:) they cant levy the same goods twice

once a bailiff levies on gods they belong to the bailiff

so another bailiff cant levy the goods because they no longer belong to you

if you read the small print on the W P A it tells you that if another bailiff tries to levy the goods you must tell him the are already the subject of a W P A

my only problem is that i cant find levy sheets

if i ask for this subject access thingy will they have to provide me with copies of the levys aswell as what payments were made to the accounts

 

and RCS put both mine and my partners accounts together when we started paying them will i have to pay two lots of 10 to get all the imformation of both mine and his debt

but i do think this is very scary because how many peaple have they done this too and got away with it.
