hi 2 yrs ago i bought a gas cooker from comet, last year just before the warranty ran out the oven wouldnt light, the pilot clicked sometimes it wud come on but only ignite for a few mins, this was rectified under warranty, at the time the cooker had been in storage for 6 months, now the same thing is happening again as me and partner work full time the oven rarely gets used but now having problems again now its out of warranty can i do anything under the sale of goods act and if so is there a template letter i rang comet and all they said was new part only had a 3 month warrantyany help appreciated

I think that you need to find out how much it would cost to have this fault repaired. If it is very low value then a court may well think that you have had two years use and you should expect small defects to occur after this period of time. If it is high value then you have a very good chance of getting it paid or at least a proportion of it paid.

The SOG test is whether the goods match up to your expetations as a reasonable consumer - given the item in question, value, length of use, nature of defect etc.

 

Cetainly, whatever happens, you will have to fight Comet because they aren't renowned for being reasonable about these things. I would expect that you would have to issue court papers before you will get them to pay attention

 

You canfind out the value of the repair by asking Comet to quote you for it (best course of action) or else get an authorised repairer to quote. Get the quotes in writing.
