Hi all,

 

I currently have a basic LLoyds account, i never used to have an overdraft or anything with them ( this was paid off with a previous charges win) then i went slightly overdrawn, due to charges i now have an overdraft of £1900 all due to bank charges. LLoyds said i could pay this off at £50.00 per month (£30.00 for interest and £20.00 towards the overdraft) due to being self employed and having little work there has been times when i havent managed to pay it which led to more charged being added (£160 each time) and every time they increased my overdraft to cover it.

 

Due to no work i am missing payments on credit cards and a loan and the overdraft i have with lloyds.

 

Do u think i stand a chance on the hardship case. I was going to wait until the court case against them is finished but im having letters daily from debt collectors and phone calls which is really taking its toll now.

Do you have priority debt arrears(mortgage/rent, council tax, utilities)?

 

I think you have got credit card charges so that is an easy peasy claim.

Any PPI?

all my utilities are upto date ( i have 2 kids so keeping a roof over their heads is important)

 

I have got a couple of charges from my creditcard company, but i'm really struggling to keep up with lloyds as i'm trying to pay my overdraft and my loan but just cant do it...

From what you have written, you're struggling but not in financial hardship(which is usually severe financial hardship). I would start the process of reclaiming the charges if you have not done so already.

sorry i forgot i am well behing in my electricty bill (£400.00) they wont let me pay monthly as the arrears are to high and want it all paid off ? does that count

Yes it does.

If you have the list of charges(for FH you can go back to 27th July 2001) then you need to write to the bank and include an income and expenditure form, plus any arrears notices and you need to explain how you were unable to cover bills from your account. For example, loss of job, hours, maternity leave, separation from partner etc,etc, and how this impacted on your ability to pay your bills.

once again had a get lost letter from lloyds about my hardship claim.... where do i go now

Do you still get charges on the account?

I know you have council tax arrears but are the charges hitting into your budget to pay these bills?

Ok, when did the income go down which meant that you ended up with charges on your account? What lifestyle event ie lowering of benefits, lowering of hours, unemployment? Are the arrears getting worse?

hi, i havent paid my council tax for 4 months and cant make payment arrangement as i seriously dont have enough funds as 6 months ago i lost some work (i am a childminder) which reduced my income by £660 a month. my tax credits have also gone down due to an overpayment..

That is our starting point then. Focus on the priority debts and furthermore send them an income and expenditure form plus notices(copies) of arrears on the council tax.

Money Advice Trust - The CFS budget forms and preparing a financial statement

The address to write to is this:

Charlton Road,

Andover,

SP10 1RE.

 

Keep the letter personal to you and make sure you claim all the charges. Explain how it has got worse this year and how in the last 6 months because of the lifestyle event that you have not been able to pay your council tax.

they didnt give a reason just said i will have to wait until the test case but they have updated my file with the additional points i have raised.

i even sent them copies of the letters from the council about my tax arrears plus my electric bill which is also not getting paid

I am going to ask a slightly different quesion. What are you being charged for? What direct debits are being returned unpaid?

There is a reason for me asking this.

If the charges did not go out of your account would you have been able to pay the council tax?

for going over my overdraft, i set up a payment arrangement with lloyds to clear my OD i started off with £900 and was paying £45.00 a month off it but didnt always get the payments into the account by the date they stated so i kept accuring charges my o/d is now £2500 and that is all due to charges nothing else as i dont use the account. due to my tax credits and salary going down i now cant pay my council tax, utility bills or the £45.00 which lloyds have put upto £75.00 so to try and clear it off...

no i moved my account from lloyds to natwest and was paying my dd but due to salary and tc going down i cant pay them anymore

When was the account moved to NatWest?
