      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

called and left message on voicemail of alan burden dg. i have also just called the court and they said if i havent heard anything by friday to ring them as the deadline for hsbc to submit a defense was yesterday. Naughty HSBC!!!

wow after waiting then more waiting - full offer received although no mention of default (ccj) being removed. ofcourse letter is marked without prejudice and has confidentiality clause. Have called Alan Burden again and waiting for him to return the call. Watch this space.

it seems it isnt possible to get my judgement removed (set aside) with these proceedings. therefore i think i'm going to take the money then start new proceedings after i received certicate of satisfaction to get the judgement deleted entirely. Anyone got any ideas of ways round the confidentiality aggreement as i want to shout my mouth off about my win!!!!

i decided to write my own letter of acceptance which i sent first class recorded today, i will not be getting much of the money as most of it will be going to settle the account which has been with creditors. however it is still great news as this debt will be cleared and i will be able to use my cheque to pay to get my ccj set aside. Will let you know as soon as i do.

called alan burden today and my payment is now being processed, it takes around 10 days he said. my oustanding debt for this account is around £900 which they will take out of my offer amount leaving me just enough to pay the BT bill and the £60 ish to start more court proceeding to get my judgement set aside.

 

I am still waiting for hsbc to send statements for my mastercard account- their deadlines expired ages ago, received a flimsy letter that i've seen others get saying due to a problem my letter went to the wrong department blar blar. i will have to start the court process again after this hsbc case is resolved (am i right in thinking only 1 claim per bank at a time?)

 

in the meanwhile with my abbey case they have issued a defense so no offer with that yet. i have a feeling that this one will actually get to court. Abbey are the worst to deal with, in my opinion.

hopefully the postman will bring news on the GE Capital bank and Time card prelims that were sent last week- unfortunately all the claims at the moment have money still owed to them (that has to be repaid!!) before i get mine so looks like the new kitchens out!!!! should get a bit tho!!!

Anyway on with the fight!

Sarah you can have more than 1 claim if its a different account number.

As regards the statements you could tell them you will only sign the one they want to settle after they give you the card statements You look like you got your hands full but you are well on the way and a battler.

thanks for replying. Yes i do feel like i've got a lot on at moment apart from bank stuff i have 3 small daughters!

 

think it's too late as i already signed my own letter accepting their offer, also i could do with the money without anymore hold ups. you know how it is!

Yep I know it takes it out of you and at the end of the day you have a result so thats some comfort.

I know the demands of children and its hard to keep focussed as while you are devoting time trying to get something back that you should have not lost in the first place,the girls are maybe missing out on this time they should have with their mum.

Maybe you are doing that when they are asleep....when they are at school...or when they are at their nans......but its still a strain.

The one consolation is that they will be better off for it tho when all is done and dusted.

I have a Lloyds Visa and Mastercard, and was advised by a CAG organiser that both cards can go on one claim.

 

Abbey is notorious as the bank who took Stephen Hone all the way, only to cave in at the last minute by paying out fivefold to placate Stephen -- "please sir do not haul me into court". Another claimant had his story printed on a full page in the Sun, getting ready to march into Abbey branch accompanied by 2 bailiffs. Not sure if this materialised, but would have made a great picture story.

well the postman didnt bring any news of money but the hsbc matercard statements have eventually turned up. not surprisingly there is a problem in so much as i am missing the first year and a halfs statements and again not surprisingly, there is only one charge on the statements received , all my charges were incurred on the missing ones!!! i called them but as i no longer have the credit card (it was passed to metropolitan 3 years ago- so card must have expired) they can not complete security. i can only go into a branch with id and get them to call and get the missing statements faxed thru. seems a bloody long way round things.

from the look of the statements received the interest rate charged goes up depending on when payment was made- does this sound right? shall try to get to the branch tomorrrow. i just want some money back!!!

oh well tomorrows another post day!

hi everyone, i have good news to report on this thread (but not on my ge capital bank - check out sarah V GE money) received letter from dg confirming the agreed sum of £340.62 will be credited by cheque in next 7 days and the remaining balance of £808.46 will be paid to my outstanding debt with metropolitan collection services. reclaiming your charges is good but it does turn a little sour when you realise that most of them will be eaten up in your outstanding debt. still they have to be paid i supose, least i can stop giving them monthly payments. also as i wrote my own letter of acceptance i did not mention the confidentiality clause so i can shoot my mouth off about my win!!! Down with the banks!

made it to the branch today and surprise surprise after 30 mins of hanging about was told that the missing statements will be sent to me in 7-10 days (not faxed) lets wait and see.

Hey, well done - I know what you mean about them goign on debts - my total claims will be around 1500 but that's what i owe over credit cards, so i'll be debt free....if I paid them off monthly, It would cost more!! so, nevermind, like you say - it's go to be paid!

 

You are keeping the claim in with the court until your cheques are received AND cashed, aren't you?
