      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I read that Deborah is leaving on 4th Sept and another guy will be dealing with claims called Alan Burden. I think for the purpose of correspondance with DG, a name is not required especially as their letters are so impersonal.

They will write to you very soon asking for a break down of charges, so send them back but if you want a cheque you should state this in your letter to them.

Hi,

Deborah is on holiday until the 4th september but there is another lady called Ellen dealing with it aswell as Alan. I spoke to deborah on the phone the other day and she was OK. I haven't had any trouble with them ................. so far!

she was a cow to me - im writing to the court to get them done for being vexatious litigants and using the legal system to buy them more time. i can prove they were going to pay out earlier and before they put their defence in. they out it in to give them an extra 14 days to get the cheque to me!!

I had an offer from HSBC today for almost the full amount (£1025 out of £1143), taking just over 3 weeks from the Prelim letter!

 

I live 20 mins from Cribbs... so La Sensa it is! :D

Excellent! As soon as I get my cheque (which could be a while judging by other cases) we can meet up and go shopping!!!!!!!!!:D

 

 

They are still trying to make me have it paid into the account which I do not want so might be a few weeks yet girls.

Ooops, I was a bit stressed when I wrote the above and wasn't at all on planet earth. Her name is not Ellen, sounds nothing like Ellen and I don't know why on earth I said it was :?

 

Anyway, the lady covering for Deborah is ........... (erm, still can't remember - sorry! I have been speaking to her though and her name will come to me in a bit. I didn't make her up I promise :oops: she does exsist, even the fairies at the bottom of my garden spoke to her. I'll think of her name in a minute or two. It's on the tip of my tongue. just bear with me...........

Still no contact from DG Solicitors, is it just me or is anyone else having the same situation?

 

Ah well if they don't file a defence by next Wednesday I can get default judgement, probably a lot quicker anyway

Deborah D'Aubney is on hols and the whole thing has gone pear shaped. Can't any of the others do her job without c**king up? She was meant to be on hols til the 2ns sept and now her voicemail says the 9th or whatever. I am not giving up if this is what they are trying to make everyone do. If they think by stalling and ignoring and filing defences will frighten me off then they have another thing coming. Bring it on. (can you tell I am mad?)

Well if you have agreed settlement and they wont pay, you could always get a court order (maybe even baliffs turning up at your branch....)

 

Imagine your bank manager being pinned up against a wall by big burly blokes and sweating, helps with the stress no end!

I received a letter in the post this morning saying...

 

"We refer to the default judgement you have recently obtained against our client.

 

The claim form did not come to our clients attention and we would ordinarily be instructed to apply to set aside the judgement.

 

GIven the amount involved, however, and with no admission of liability whatsoever our client is prepared to settle the judgement for purely commercial reasons.

 

Your account has been credited with the sum due. Please sign and return the enclosed form to us in order that we may apply to the Court for a Certificate of Satisfaction. We enclose a stamped addressed envelope for your convenience.

 

Yours Faithfully...

 

Ive just checked online and the money is there!

Got a letter from DG Solicitors asking for a breakdown of the charges.

 

I called and spoke to Alan Burden, who seemed most perturbed when I argued the point that the lists were supporting docs and not Particulars of Claim. Ah well, will fax them over tomorrow and see what comes back.

 

Will keep you posted....

Not long for you now Claire, You should get an offer in a few days. I know Alan is swamped with claims, I phoned him yesterday to chase up the payment and he called HSBC and they posted the cheque straight out. it arrived today. The best thing to do is keep ringing and hurry them along! They will soon get peed off with you and be glad to finalise your claim and get rid of you if you annoy them! Try it, it just may work!

jUST A QUICK QUESTION ???????????

 

My son previously had an offer off Colin Langdale for less than the charges he was claiming etc.. so we replied with the LBA ETC.. now the 14 days are up and no reply still to offer the full refund etc..

 

I am about to file my son's MCOL - do I put the address of HSBC as Arlington Business centre as per Colin's letter ?? on the MCOL form for papers to be served etc..

 

Thanks for that - I am tired and just being dim right now.

 

Previous letters we'd sent to the branch for them to forward etc..

Well I think previous advice was to use the head office address, ie Canada Square, London.

 

Personally I just used my branch address and that seems to be fine. It all got replied to, so up to you really.

Claire - thanks for that - I shall issue MCOL at the branch in that case - they can forward it on like the letters etc..

 

I just didn't want to screw up on the last stages LOL :0)

 

Nearly there for him!! Be so nice to see my lad have his money back - it's not a lot - but hwne he is studying it's awful lot of money that I'd rather see in his pocket and not the banks coffers!!

Yes, I used my branch too.

 

It doesn't matter how much or how little - I claimed £45 back from my HSBC credit card, lol. Every penny is ours!
