Hi ... I opened a FD current account in 2005 whilst claiming back charges from another bank and to try to sort out my financial mess.

 

I again find myself in a financial mess and am wondering if I should start to claim charges back from First Direct - approx £700 since 2007 and then whatever they took in 2005 - 2006 but I dont have statements from these years.

 

Do you think that they will close my (overdrawn) account if I do? Also, as there are so many useful threads on this site, where do I go for the sample letters and where should I start?

yep i'd claim them back [or atleast get in the queue, as not cases are being dealt with under the current stay]

scoll up and look in the cag announcements fo the pop up that tell you what to do.

 

as for them closing the a/c, that would be seen as a retalitory act and thus could well get them in a lot of trouble

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Have gone ahead and asked for charges back... got a reply today stating that claims have been stayed until judgment etc. I have applied for hardship status to First Direct and sent a financial statement. Eagerly await their response. Have also opened a new bank account and shifted my salary and essential payments to that account. All thats left with FD is an overdraft which would be cleared by a charges refund :-)

I'm new to site, just wondered how your getting along with F.D claim?

Have they responded?

 

I have a first direct loan from Feb 2007, need some advice on if it may be unenforcable? Confused bug time been reading threads for over a day now.
