Further news...

 

LFOL replied, sending me somebody else's Consumer Credit Agreement (!) - not mine.

 

So they are still in default, and have added a major breach of confidentiality to their dubious record!

 

They also enclosed a statement from MBNA which clearly indicates that I did NOT default in 2008,

which means MBNA's purported assignment to LFL is almost certainly invalid.

 

I am copying details to the Ombudsman, where my LFL complaint remains pending.

 

So LFL/LFOL are trying to collect on an assignment of dubious validity, made in breach of the repayment agreement which was in force at the time.

 

My understanding from other posts is that such a situation precludes them registering details at a CRA

- is this true, and can somebody please quote "chapter and verse" about that?

Nothing more happened; the matter has now dropped off CRA files, and is dead!

A debt is Not dead when it is removed from CRA files, this is an automatic process all defaulted accounts are removed after 6 years paid or not.

In England & Wales debts still exist even when they become statute barred.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.
