PayDayUK Charged Debit Card Without My Authorisation URGENT HELP NEEDED

Ok so I defaulted on my loan with PaydayUK

They passed it on to their Debt Collection Agency yesterday as I was informed by email yesterday morning. So I got paid yesterday but havent paid my rent or bills yet

 

Anyway

£275 has come off my debit card from MEM Consumer Finance (PayDayUK) yesterday at 2:38pm WHILE I WAS AT WORK

 

I Did NOT authorise this payment and dont know what to do now as my bank says i Have to talk to the company about it. Can they do this??? Considering A) I Didnt authorise it and B) They passed me on to a DCA??

 

I defaulted on the loan in March so its been an ongoing issue since then.

 

Any help ASAP will be much appreciated

You will need to check the terms & condition of your loan agreement with Payday UK.

 

Unfortunately i think there is a clause somewhere in the terms and conditions that say if they are unable to collect payment on the due date they will attempt to charge your card again.

If you read the terms & conditions it says somewhere.....

 

"You agree to pay Us the Total Amount Payable on the Payment Date, and You grant us permission to debit that sum from the Account using either a cheque or debit card"

 

So you could argue that they did take payment on a date that was not agreed. I would either email or write to them and ask them for an explanation, once you have there final response i would log a complaint with FOS

Hi Student - really sorry but I think they can do this - the terms of the agreement generally are that they loan you the money and take it back from your debit card, the details of which you give them. I understand the difficultly of your position but I don't think you will get very far arguing about the debit card issue. You can't really revoke that instruction with a debt o/s.

 

Has the debt now been cleared? If it hasn't you could ask the bank to re-issue the card to you so the old one will no longer be valid. that will stop PDUK taking money from it, although they will still chase you and add on huge fees - these companies all have very agressive enforcement policies - it is the nature of the busienss I'm afraid.

That's the problem when they have your card details. You will be in for a fight if you try and get them to pay it back. They will resist and your bank will no doubt say nothing to do with them.

 

These companies don't care if you can feed your kids let alone pay the rent!

 

Easier said than done but you will probably have to put it down to experience. Most importantly though, 'lose' your card and get a new one! - just in case!

I know Im in for a fight but I dont mind fighting if it means I win and tell others how I did that!

 

Yes I owed them the money but they had neither right nor authorisation to clear my bank account. I have phoned my bank and told them that this company had no authorisation from me to take this money given that it had been passed to "an external company", their "Debt Collection Agency" Keyes Whitlock and Partners on Friday morning and later PaydayUK took £275 from my account............. This is my ground for my money to be returned and a deal negotiated.

 

So Keyes Whitlock and Partners should not have had my debit card details in the first place, if they really are as advertised by PayDayUK staff, a completely independent company.

 

It goes against every rule in the book - misleading customers making them think its someone else when it really isnt.

When you apply for a payday loan they are pretty clear on the fact that if you default on repayment, they willl continue to attempt payment from your account for up to 60 days. They were quite within their rights to take the cash. Im surprised that you got a refund! :O Did the cash go into your account that day?
