      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi folks,

 

Right I have just sent off my letter and postal order for £10 to GE capital requesting my statements and charges info. I had to phone GE capital to get my old account numbers as I no longer had them as I had stopped using the DEVILS DEBT a few years ago! But the charges followed me for a long time! The guy in Customer Services kept telling me that I did not have any accounts with GE....but after much effort I told him to do an address search under my name and date of birth. So he eventually found them and gave me the opening and closing dates of the accounts....some where still open, in fact one had a 74 p credit on it which i asked him to send me a cheque to that value....he said are you serious, its only 74p and I reminded him that if i owed GE 74p and did not pay they would charge me about £20! Its my money so give it back...he said the cheque is on its way!

 

I sent one £10 postal order for all 4 accounts as it is the same company and thus they have all my info.

 

I now wait for their reply....I am sure that they probably wont reply and just ignore the letter and cash in the postal order as they seem to do that.

 

But fingers crossed.....

 

Any advice or comments greatly welcomed!

 

Anyone got any contact details for anyone in GE that I can email or phone if I get no reply?

interesting that they gave you account details over the pohne, i am going to try that too, see what chagres they made on my store cards in the past.

 

Did you send them a SAR by recorded?

 

Just a thought, if you can use a cheque and recorded it gives you confidnece to know its arrived and you can confirm of course you knw when they process payment.

 

I do realise that the deadline in terms of the DPA starts when they receive the SAR, but for me its another way of helping to track whats happening.

Hi Bokebeast, Just do a quick check on your account, in the near future because they HAVE credited the £10- fee back to claimants account on several occasions. Especially if it's a postal order, much more difficult to check really! Think they rely on these tactics to delay, or could they just be incompetent. I'm going with the latter, he he....

Yes i see what you mean about the cheques being easily traced, but i dont actually have acheque book so had to do it that way. But each postal order has tracability now....so you can phone up with you postal order number (on the reciept you get with it) and they can tell you if it has been cashed.

 

The only account info they gave me over the phone was my account numbers, balances and date when the accounts where opened

and closed, but i wasn't given or did not ak for charges info.

 

but I have sent the DPA letter by recorded so i am waiting patiently for a reply.
