I was hoping to get a default removed from my credit history. Its the only default I have, which was for £34 back in 2005. It was with T-Mobile. They never issued me a letter saying they would default me. I wrote to them recently using a template from the internet and they wrote back to me saying..

 

"I refer to the information requested within your letter and confirm that the Service Agreement you have entered into with T-Mobile is regarded as "exempt" under the provisions of the Consumer Credit Act 1974 and as such we are not required to file a notice of default prior to termination of the Service Agreement."

 

Surely this is rubbish and every company needs to inform you before they apply a default aganist your name.

 

Where can i go from here?

Hi Marie,

 

If the agreement is an exempt agreement then they are not obliged to send a default notice.

 

Why do they say that the agreement is exempt? Do you have a copy of the agreement?

 

Also, what was the £34? If it consisted of default charges you can get it removed anyway.

Hi.

I have a copy of the agreement, that they sent me when i requested the default to be removed.

 

The default is for £34. Which was paid a few years ago. (marked as satisfied)

 

How can i go about getting it removed?
