My name is John and I have been lurking on here for some time - and I have picked up some great advice, so firstly - THANK YOU!

 

Here's my dilemma.

 

18 months back i used a car park for work, I used to get parking tickets, and pay them in full quite regularly.

 

I accrued 5 tickets in one month - a PB for me! unfortunately i DID NOT pay these tickets (stupid, I know) at the same time as this i moved address and failed to change the address on my V5 logbook unknowingly (I’m not the best with cars and only thought to do it a couple of months ago)

 

Anyway, the 5 tickets went unpaid and the debt got passed to JBW who contacted me at the start of March demanding just over £900 or my car would be taken.

 

I borrowed £400 from my parents and said this was the best I could do. They accepted with an agreement to pay another £100 at the end of March (pay day).

 

When payday came around I paid the £100 and told them about my bonus at work that I get at the end of April (this month) and that if I could, I would clear the remaining debt of £450.

 

I know that ultimatley, I am in the wrong and I got myself into this mess. My gripe is this; Between making the first payment of £400 and the next payment of £100 I had SIX phone calls asking me to clear the owed amount, even though I had promised to pay on payday etc! Then since making the payment of £100, today I have had TWO calls, first one saying I had broken the arrangement and when was I going to pay second one saying exactly the same thing – I had to explain the situation twice AT WORK!!! I gave them my work number because I work 14 hour days mostly, and I fully intended to pay so thought this would not be a problem for me.

 

All of these calls, have been rude, abrupt and verging on threatening – even though I have bent over backwards to afford to pay these people. The very 1st guy I spoke to was polite and very proffesional, understood my situation and made me want to co-operate.

 

What I need to know is where do I stand – can I do anything i.e request any info / say anything to them to stall things make it hard for them – are there any companies out there that would take this case on for me?

simple dont answer their security questions and demand that everything is in writing, they see you has an easy target because you are paying and some phone drone wants to make his bonus up with some more money

Am i within my rights to refuse to speak on the phone and demand everything in writing?

They are also bailiffs not debt collectors - get the arrangement in writing or you will have no back up if they decide to remove your vehicle which they can find at your home or through ANPR

Yes i will ask them for everthing in writing next time they call - I take it from the lack of responce that there is nothing i can really do about this?

HI All UPDATE!!!

 

I just phoned JBW to try and pay £120 off of my £454 Balance.

 

They REFUSED to take the payment saying it was ALL or nothing!!! They said the case was warrants and they would just take the vehicle rather than take £120...!!!

 

Can they refuse to take the payment??! i asked for the fact they would not take the payment in writing, this seems very strange!

If you want an answer to a specific thread then it is best to bump it up by posting a bump.

 

Also you complained about them telephoning you and then you call them.

The idea of putting everything into writing is soyou have a record.

They are talking nonsense.

Only a county court can authorize warrants/or bailiffs etc...

JBW have no legal powers whatsoever.

Report them to the OFT/trading standards & the police (not 999) if they continue harrassing you.

The fools have just talked themselves out of money by refusing your offer...well now they can just accept £1 per month once a county court authorises it after your outgoings are taken into account.

Insist everything must be in writing only if they phone & refuse to answer security questions.

Whilst reading this last post I just had another call from Crapital it went thus:

 

"May I speak to Mr Game Keeper?"

 

GK "No"

 

"ok!" phone goes down.

 

They should fight fair and at least put up a bit of a struggle

Well i just paid £454 to them... cannot be arsed with it. They said that the council had issued warrants..etc.

 

However i did record the call and the guy taking the payments said Sh*t 4 times and F*ck twice...

No just being w****** are also a debt collection agency ever since their westminister contract went tits up last year. Hence they aregetting 2 jobs for the price of oneas they took tjmeagher over in 2007.

Report them to Trading Standards and the OFT for using that kind of language. Make sure you send them a recording of the call!!
