      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I purchased an Advent 1115c from pc world in march last year i was virtually computer illiterate at the time and my pc knowledge is still (basic).I recieved a letter at the begining of march this year informing me that my 1 years warranty was due to expire and i was offered their cover plan which i signed up too,there was a problem with the cd drive not opening i sent it in under warranty to be repaired as the warranty still had 2 weeks left,the laptop was retutned with the cd drive working however a (completly new fault had appeared),i called them up and sent it back under the (coverplan), they informed me over the phone that by the nature of the (new) fault i was reporting it would need the motherboard replacing?, i had made backup disk's however i had no idea that i would also have to make a (recovery disk) and nobody from the tech guys mentioned this while i was on the phone to them.The laptop was returned approx 3 weeks later when i phoned the tech guys again to report a blank "dos" type screen they then told me to insert my recovery disk, hmmm now you mention the recovery disc thanks a bunch, i was told to visit their website and order the recovery disk, i tried to do this from a friends house because i had no other computer and all i got was "page not found", i phoned again and was told that the only way to obtain the recovery disc was via the website. I bought a reconditioned laptop from a local retailler and got back online, i have tried every web address for the tech guys and the same thing happens "page not found". They say its an intermittant fault with people using AOL so i now have a completely usless advent because i can not obtain a recovery disc,because i cannot access any of their websites including the "direct link" from the pc world site, has anyone else had this problem with the tech guys site? and does anyone have any suggestions as to how to obtain this disk i do not live anywhere near a pc world store and all i get from the tech guys is,sorry you have to go throught the website to obtain the recovery disk,i have even made a vid with my webcam proving that its impossable to get on their website.

yip your right the link does work but when you request post,and go to check out and try to buy it asks you to log on or create an account as soon as i click "log on" or "create an account" it then boots me off to "page not found", this is what i have made a video of because i have managed to get on this page once of twice before and that's exactly what happens everytime and i still have a (valid coverplan agreement).

click on my account and then change address, email address and password. then click home and find your recovery disk - you should be able to buy then....

yip and guess what the same link that worked a few hours ago from your earlier post has stopped working now for me, also the second link you just posted will not work.I made a quick vid of it but just realised i could not post it as an attachment here its just "weird",and very frustrating. I have not had any problems with any other links just "the tech guys",as i say i can sometimes get into the site but as soon as i try to sign on or register the same thing happens i got a vid of that too just wish i could prove it by posting it as an attachment here,i may post it on you tube because it is so dam weird.
