Hi all.

 

I'm sure I read that student loans are not subject to CCA issues before 1998.

I believe mine was taken out in 1998.

However, Westcot has now bought the debt.

 

I have requested my CCA from them, but if it looks unenforceable will a court be able to make it unenforceanle because it is technically a student loan though now sold on?

Got a letter from Westcot 2 weeks ago saying no further action until CCA found.

 

THEN...today, received old statements from Students LOans Company suggesting that my balance had been written off in 2004???

Do you think then my loans have been written off - they are quite old!

Then what about Westcot - I have been paying them £50 per month for a year - can I claim this money back from them - ...if there is no debt, then how can they keep that money from me???

Hi, blue eyes.

 

When an account is written off and sold the balance is returned to zero by the original creditor. That is why the balance of the account currently shows as zero balance on Students Loans Company records. (I think).
