Only got to image 5 and thats enough for me and should be to anyone that this is a clear case of the law being broken by all and sundry? thank god for clear english, in my view enough for anyone in the position of being repo'd or chased for a shortfall to go to the police with that in mind or any court and charge them with a no of acts of wrong doing

 

or am I on wacky bacca

I would DEFINATLEY take that with the House of Commons header sheet and that section outlined to any repossesion hearing and ask that the judge studied it before hearing any evidence.

I to will be printing this off to hand to the judge on tuesday.

 

If you think that any of that document applies to your case then you should mark the relevant section and fax or take it to the court tomorrow and ask for it to be put with your defence so that the judge reads it before the hearing.

I'm NOT a lawyer, not even a barstool one Dotty, so... take this with a pinch of salt, but - if I'd had access to this doc when I was going through my repos, I would have highlighted in particular the section where it is explained that the "plaintiff" *may* be masqerading as the owner of the mortgage, which *should* trigger the judge to ask them for proof positive of their legal right to reposses. It would be likely that the shiny-suit from your "mortgage company" will not be able to do so *if* the judge takes on board Ms. Butlers description of SPVs and the "Plaintiff" as being on the Land Registry when they perhaps shouldnt be.

 

There are a LOT of "perhapses" in there... please remember I'm NOT a lawyer but I have been through similar to you, and that, as a lay-person is what I would have tried to do: use the document help the judge have a question that the "plaintiff" cannot answer correctly.

Just a heads up on this that I've asked a friend of mine who is a pukka property / conveyancing solicitor to go through Ms Butlers testimony and see what they think. I'll post as and when I get any feedback.

Can someone advise please. I fell into arrears with my mortgage due to be being unable to work (I am self employed) due to a bad back. I am now on pension credit and the pension credit pay some of my interest. I was in court with my mortgage and a suspened order was put in place and to review in six months. After paying my mortgage plus £50 for the six months, mortgage plc did not turn up for the hearing and neither did I (I was ill at the time unfortunately) In the six month period of paying my mortgage I was contacted by my local hospital to go and have a operation on my back. (I had a slipped disc on one side and a trapped nerve on the other side painfull believe me!) At the moment I am really struggling to pay this March's mortgage. What I need is some form of letter to send mortgage plc explaining the situation that once my back is ok (maybe a few months) I can go back to work and earn decent money to pay off the arrears and mortgage payments.

I am new to this Forum but specifically joined because of this thread.

 

I have read in detail Carmel Butler's report, particularly sections 44 to 50 which are extremely relevant to consumers.

 

This report has been passed to an eminent QC who has great knowledge in such matters and he will report back with his full opinion to a Luxembourg firm of Forensic Auditors, Loancheck SA.

 

They will then make this opinion public.

My personal take on the Report is that, having had some experience of such legal assignments before, Carmel Butler is absolutely correct in her assertion that the actions taken are (technically) in breach of criminal law.

 

The Forensic Audit firm are likely to be in a position to report the findings before the end of March.

I am asuming that something on this scale will have been going on long before Ms Butlers, report, and will have been gone through with a fine toothcomb !!

Was wondering why there seemed to be a lot of activity on companies house website, with our friends and their millions of listed companies !! mmmm!!
