im in the middle of a argument with vodafone over a 24 month contract that i never agreed to

i ordered a new phone on the 25th of january 2008 and as i was coming up to 12months i thought id check other deals and networks for an upgrade but when i checked my online vodafone account i realised they had put me in a 24 month contract !

i never agreed to this on the phone and as far as i was concerned i had done my 12 months

i emailed vodafone asking for a recording of the phone call or transcripts to prove that i had agreed which i know i would not of

after many back and forward arguments they finaly told me they could not let me have a recording or any proof of the agreement

eventualy they told me that on the date of me ordering the phone my contract was upgraded from a 18 - 24 month contract meaning they must have changed it on the same day

they have tryed to sweeten me up by cutting it from 24 months to 18 months but i still think without a contract in writing or the recording of the phone call my contract should of finished this month

 

can anybody give me advice on where i stand please i have looked through the unfair contract act but most is above my head allthough i belive i did read a bit that says that the party should be aware either in writing or verbaly at the start of the contract

No - the onus is with you to prove they didn;t keep their side of the bargain. You would not have has a 12 month contract, even if this was the original duration, as the industry has moved to 18/24 as standard. Their recordings are to assist them, not help you - so unless you have kept your paperwork or have other corroporation, their interpretation will prevail.

 

The fact that the contract duration changed at the start is easily explained, your handset price 'floats' until you decide what the minimum term is, if you are haggling for a cheaper phone, the dealer can invariably make the phone cheaper, but the downside is the minimum duration is extended.

 

You should have seen some confirmation of the contract which would have confirmed the term, but non-provision of this doesn't invalidate the contract. It is expected that if the customer doesn;t recieve these details, he should call and ask for them - and as you discovered, it would have been better if you knew then, than now.

The best thing you could do is ring 191 and aslong as you get through to the right agent who is willing to help then you will have all the help you will need to establish whats happened and what can be done for you...

 

Have a look for the Letter that Vodafone sent when you actually did the deal as this will outline all of the agreed terms of the contract, including the priceplan, length of contract and any extras etc....

 

Also, if you do decide to speak to an agent, then ask them if you were contacted by their outbound sales dept and offered a contract extension for a bill credit, this has caught out loads of customers as they except this thinking its great untill they come to their upgrade time and then realise they have to wait an extra 6 months...

 

The offer of a reduction from 24 to 18 months is a good offer.... What price plan and handset did you take at the time of the deal? Depending on that then you can work out whether your on an incorrect deal etc...
