      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

in terms of the food chain, ARC are simply DCAs, usually (though I dont expect always) acting as an agent for Egg. They simply do as they are told (ie get the money). Trevor is simply a solicitor who "works" for ARC (I suspect, largely its the supply of appropriately headed note paper and provision of a reasonably convincing letter that is about as much as Trev does for ARC). The real target has got to be Egg.

CPR is, as I understand it, a process in English law for the disclosure of documents - a few more steps along the same path as s78 and SAR requests. An Incidental application would be the equivalent in Scotland. But both work from within the legal system and are about disclosure of documents.

I think what you are getting at - perhaps - is to finance a test case against Egg to test out the adequacy of their CCA agreements, and in paricular "Approved limit".But, again as I understand it, there are cases at Cardiff and at Manchester just now (or very soon) which will at County Court level (ie in England only) test it out. Whether this will bring closure is by no means certain. If Egg lose, I would think they would (have to) appeal the decision. If they win then there might be a group appeal. This could run for a good while yet. Not satisfactory for anyone really. :(

Hi all I recived 1 letter sent via ARC contacted FOS as stated in another threed my reason I was paying another DCA then contacted out blue as stoped paying other DCA back in April no statments nothing sent did not know how much i still owed never bothered communicating with me always told that dca owned my debt not egg ARC tell me they are acting on behalf of client and I can relog on to my egg card online this also mention to FOS not been able to since 2004/2005 gave ARC Fos ref number and they stated they would email egg have heard nothing as yet I have old CCA somewhere (can remember wording mind "aproved limit" not proscribed term but am going to send new cca request this week and prob "SAR" also fighting Barclaycard and thats about to get Dirty.best of luck all anyone have an idea on dates of egg test case

Hi all,

 

I'm back... after a beautiful quiet period, my Egg c/c account has now been passed onto Aktiv Kapital.

 

They are pretty persistent, plenty of phone calls using their freephone and

London based numbers (which are rejected).

 

Only received two letters, 8th and 15th May 2010.

 

They tell me they have recently purchased my outstanding balance from Egg, and they will collect the money on behalf of Aktiv Kapital Asset Investments Ltd.

 

Ummmm.... Moorcroft, Arc, Trevor Munn, Aktiv.....

 

Let's see how long this one carries on for...

Hi Hopster, no didn't know about the June outcomes... there seem to be so many 'test' cases, I'm losing count.

 

I'll try and see if I can find out anything. Keep your radar active, you never know!

I am sure that they can. That may not let everyone else off the hook. We will need to see the documentation of the case - is it re. unenforceable agreement or to do with the termination/cancellation of the agreement or both ? Do you know ?

i all,

 

I received from Aktiv on the 1st June, with a rather suspicious looking enclosed notice of assignment letter. The reason I say this is because whilst it has egg trademark in the top right hand corner and their registered address, it does not indicate any a/c number, outstanding balance or any other personal details.

 

I shall scan it in. Anyone else had anything similar?

Sorry that's me and my scanning. Hubby needs to load the full Adobe package onto the system which would allow me to save the rotation adjustments.... . Let me scan it again the right way up. I was just being lazy!

This has been bounced from Moorcroft, to Arc to Trevor Munn and now Aktiv.

 

Egg have received a letter stating the a/c was in dispute back in January 2009. Since then it has been passed from pillar to post. I know that interest cannot be applied, neither can payment be requested. However, whether or not they can 'sell' the a/c to a DCA, I'm not 100% clear.

 

I'm sure someone in the know may come along and confirm. I guess because they're not getting a penny from me, they will try every which way to get it from whatever means they can.

I sent all the DCA's the same letter informing them they were breaching rules and to be fair they have all returned the account to Egg upon receipt. This is the first one I have seen where they have sold the debt on but I am sure others will have had the same treatment.

It will be interesting to see whether selling the debt on whilst in dispute is permitted.

Hi all,

 

Just to keep you in the loop, my telephone calls from Activ have petered somewhat, and received 3 letters since June.

 

June's letter state they are here to help me - ignored

Another letter received in June, saying, "please do not ignore this letter"

My last letter was received beginning of July with FINAL NOTICE emblazoned across the top and my a/c being transferred to their Specialist Collections Team.

 

Will keep you all posted.
