hi guys, hope you guys can help. and i hope this is the right forum.

 

I have a bit of a problem. I recently received a letter from westcot, asking me for £60 for a debt with sky. All well and good, one issue is that ive never lived at the house they have listed. I suspect an ex of mine, who i used to live with, has moved from the house we lived at and opened a new account at this new address. I did cancel sky before i left the old house. Im in Scotland. and westcot keep sending me letters. i have sent tenancy agreements from the houses i have lived at during the time the sky account was open, but they still are sending me letters.

 

Im not sure what to do. Its fraud but how can i prove it. should i send westcot a CCA? or should i contact the police regarding the fruad or both?

It won't be fraud until you see the contract, so do the cca request and then decide on your next move.

Don't forget the £1 charge, and if you want to sign the request, use your left hand or get someone else to sign your name so you can compare sigs when, or if, the agreement arrives.

The onus is on them to prove you owe this-not for you to prove that you dont.

From what you say,its unlikely that they could show it to be your account.

 

I suggest that you send Wescot a letter putting them on noticethat if they continue to send their demands,that you will contact the FOS and your local trading standards.

They are in breach of OFT guidelines,and also Unfair Consumer Terms regs 2008.

Give them 14 days to send you an undertaking that their demands will cease.
