Hi there every one. Iam needing help on this issue.

 

i bought a computer 2 and half years ago from pc world. paid for it cash and gave my bosses name and address details as the buyer,( he wanted to claim the vat back on it). i paid for it and never at any point did he or his company have it. i took a insurance policy out for a free trail and gave MY bank details for this.(only to cancel it a few days later.

to get to the point

 

the computer has failed big time and they will not deal with me because.

 

1- i have no reciept.

2- my name is not on the buyers details at the point of sale

3- they say they can only deal with the person whos details they have when the machine was bought.

 

my problem is.

 

i have no way of my old employer helping me on this as we have not spoke for a few years, so that was the only option i had, so say pc world of this getting sorted.

i asked them what data protection laws would be broken if they delt with this problem with me and not my old gaffer. after all i paid for this item, i was the point of sale and i have always had this as my own.

 

 

Please please some on help me on this. are they right in what they are saying, or is there away round this?

 

i paid £999 for a top of the range computer only for it to fail within 3 years.

So, basically, you are admitting to conspiracy to defraud as far as the VAT is concerned?

 

Good plan on a public forum.

 

In short, you are not apparently a party to the contract as your name is not on the receipt, etc. so SOGA does apply for you.

 

If VAT was reclaimed, then this was a business (rather than consumer) purchase and therefore SOGA doesn't apply anyway

Sorry OP, but you have bought this predicament on yourself.

 

There is the point of contracting with the person standing before you, but good luck with trying to prove that one. You would have to get someone at the store to say "yes I remember that person" or prove that it was you - somehow.

 

he bit about it being for business that Patdavis touches on is arguable as there are tests. However, that it is the least of your concerns so far.

 

Sorry if that sounds off, but as a consumer, you have done everything wrong, and worse still, were not victimised.

Company got the VAT back afterall...OP is just the user no?

 

Unless I am missing something...what do you hope to achieve? You didnt go for insurance and I assume extended warranty...and I also assume you had a standard 1 year warranty with it - ie: this has expired too?

 

What laptop is it and what is the problem with it?

vat was never claimed back. i just wanted to know where i stood on buying the machine but giving some other persons details , as regards to data protection laws.

 

the computer was a advent t100 all in one machine. think it were a main motherboard. seems this model had a flaw that effects most of them.

 

well it looks like i am out of pocket.......lesson learnt

 

NEVER EVER WILL I BUY ANYTHING FROM PC WORLD.

Nah, the AIOs are generally wack and designed to spec, hence spares are difficult... Give them the right details and buy a proper machine and they are fine.

My Advent PSU blew

 

It was very small. I got the smallest replacement that I could do that would fit in the case - cd drive sticks out the front now to make room for the psu

 

Not pretty but it works
