      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi all great site!

 

i guess im in the same boat as everyone else here, i have been a disgruntled customer of the halifax for 12 years and have endured a lot of these " fees ".

 

one of my work colleagues is in this process too a bit further on than me so he is giving me a hand but it is nice to see other people arround the country having the same problem and hopfully the same success!

 

i posted the DPA letter on 2/6/06 and have heard nothing as yet but will keep posting!

ive just read the money mail article stating that people have had their claims rejected by the courts pending a decision by the high court, is this true ?

if so are we better waiting for that decision or just going ahead as per?

this is a disturbing devlopment, im sure their high price lawers will find a way for them to get out of paying us our money or at least making us wait and then not paying all they owe us !

Keep going! If the charges were unlawful two weeks/two months/twp years ago, they are still unlawful! You will get them back if you follow the step by step advice given on this site. Nothing has happened (in the Daily Mail or anywhere else) to change the fact that these charges are and always have been unlawful.

after lba halifax offered 350 on claim of 4k+, would like to chew it up and spit it in their face but do i need to reply or just file in court on friday at the end of the deadline? by the way they sent an acceptence form and said if no reply in 8 weeks " i will assume i have nswered your concerns to your satisfaction"

You can do two things, either don't accept their offer or reply saying that you accept the offer only as PART payment of the full ammount and tell them you will still be pursuing the full ammount. The reason they have doen this is that they know you are in the right and they are wrong. Carry on with the process as normal. I was in the same boat (I am now a little firther down the line). They offered me a pitifull ammount Ignored them and just carried on as normal.

04/05/2006 - Prelim req for payment sent.

24/05/2006 - Letter before action sent.

05/07/2006 - Claim started for £681.67 + £80 court fees

28/07/2006 - PAID IN FULL:£761 (thanks to CAG!)

I meant to say at the end that I ignored them and carried on as normal. They will scare you with all sorts of letters so don't worry. This is your money just follow the process until you recieve all your charges back.

04/05/2006 - Prelim req for payment sent.

24/05/2006 - Letter before action sent.

05/07/2006 - Claim started for £681.67 + £80 court fees

28/07/2006 - PAID IN FULL:£761 (thanks to CAG!)

Please stay on one tread per claim, it will make life easier for all.

 

File away when time's up, that will be a clear sign you do not accept their offer.

 

As for the "no hear within 8 wks means we have resolved your concerns" means nothing. A lack of response can not be deemed to imply acceptance.

im going to speak to one of the customer relations managers this afternoon, my claim is for 4357, if it were to end up in court with int it would be about 5400 is it worth me saying to her i would except 4k if paid into account at close of biz today, or would this prejudice my case, i realy need the cash and dont want to wait but will if ness!

My claim was started on 05/07/2006 and acknowledged on the 13/07/2006 they finally paid up on 28/07/2006. So they paid within 18 days (the dealine is 28 days)

04/05/2006 - Prelim req for payment sent.

afternoon all!

anybody aware of the timescale between case being acknowledged and settlement, i heard that halifax are stepping up a bit and people are getting settled within a week is this true

i filled my cliam last week and was acknowledge on the 4th august

just wondering the date you filled , was ackknoledged and if they have paid yet.

i filed last sunday and they acknowledged on the 2nd, i have not been paid as yet but there are people who were acknowledged on the same day as me who were settled on friday, iassume i will get mine today or tommorrow, i think you will be a day or two behind, please let me know if your paid and best of luck!

Acknowledged on 31 July. Settlement offered by letter on 2 August.

 

I have just telephoned the number on the letter (the complaints department) and the woman I spoke to - who was surprisingly friendly - said there is a backlog at the moment and I may have to wait up to seven days to get my money. Not sure what the best way is to speed things up.
