Hi Everyone, I am brand new to this so please bear with me. I recently had trouble making repayments on a Graduate Loan taken out in May 03. I have paid every month for the last 5 years. I then got into difficulty and missed some repayments. The letters and phonecalls started, I went into my branch and they said I needed to speak to the arrears dept and was told that I needed to pay £900 immediately, with a lot of begging and stealing I managed to get the money together. I then 2 weeks ago received another phonecall stating that I was in arears again and I was hassled to pay again, I explained that I had sorted this out in branch and they then put me on hold and then finally said it was a admin error and they should not have contacted me. I then received another call 1 week later saying that the direct debit amount was going to be reversed to my account due to lack of insufficient funds. I proceded to ask why there were not enough funds and was told that I had been charged on multiple occaisions for exceeding my agreed overdraft limit and for the arears on the loan. I then asked the agent on the phone what the outstanding amount was on the loan, he then also informed me that the loan would not expire until 2014. I then explained that the loan agreement was for 7 years and he then referred me back to my branch to discuss this. I have been into the branch and queried this with them and they have also said that the 2014 thing is correct. I verbally requested a original copy of the agreement last Thursday, 4th December 08 I received a voicemail stating they could not find the original agreement and that they would carry on looking. It is this that has brought me here, I need to put something in writing to the bank to obtain this agreement but I have no idea how to word it. Doeas anyone have a template to obtain copy of the original loan agreement from the bank?

 

Any help on how to word a letter to obtain this including all the CCA legal stuff would be very much apreciated.

Yes keep all request in writing with proof of posting and keep a copy.

Hi Everyone,

 

I have finally received a copy of the agreement from the natwest within the 12 days. I am not 100% sure but it looks like it may be a re-production. I am frantically now trying to find my original copy to compare the 2. The so called copy has arrived on 2 sheets of A4 today 23rd December the copy with my signature on looks correct but the signature of the person on behalf of the natwest looks as if it could have been signed yesterday, it is ultra clear and a lot darker than mine. Are banks allowed to reproduce different copies of forms?
