hi

anyone got a rough idea re timescale to settle on personal injury claim re car accident

I crashed my car into wall to avoid a t bone style accident as someone had pulled into my path.no charges brought although insurance companies now arguing over blame is this one for the long haul

Personal Injury claims vary greatly depending on the nature and severity of the injury, and also depend on liability being agreed.

 

If liability is not an issue (ie the other side accept liability), then it will speed things up considerably.

 

What will slow it down is the nature of the injury, is it long term disability, is there a chance it will re-occur, is it likely to be permanent or could it develop into being permanent.

 

If it's 'only' whiplash, ie you had a stiff neck for a few days and nothing else, and it's not likely to ever cause you any trouble again then that could be settled within 2 to 3 months, same goes for any other 'minor' injuries ie cuts bruises etc.

 

However, if it's more serious then it could take up to 2 or 3 tears to determine what a fair settlement is, however if in the meantime you are suffering financially ask about an interim payment in accordance with the rules of the Supreme Court Act, this allows the injured party to receive money before the final settlement is agreed without prejudicing the final settlement figure.
