Just back from court.

Barclays claimed that they had updated the account to read settled as soon as they realised I had gone back to court. They showed a screen print from the Experian files showing it as settled.

Judge said I had been correct in refering this back to court and was glad that Barclays had taken the time to mark it as settled before this hearing. ;)

Judge struck it out but with liberty to apply again and suggested that I get a further credit report and if it showed anything but settled, to refer the matter back to court again.

Funny thing is, I got an email reply from Lee Hancock at Experian just now. He says that Barclays have now wiped the entry in its entirety!

Dear Mr Noomill060

Thank you for your e-mail received 25 March 2009.

I can firstly confirm that Barclays have removed entry C3 from your credit report in its entirety. I have processed an up to date copy of your credit report as evidence of this.

I have requested the information regarding the dates of the previous Barclays updates and will forward these to you in due course.

With regards to the delay in updating the entry this was due to a significant discrepancy with the January data submitted to us by Barclays. We were subsequently awaiting confirmation from Barclays that the data was accurate prior to loading this to our database.

You are correct that Barclays do have direct access to our system and I am particularly surprised at their comments due to the terms of the contract they hold with us.

If you do have any evidence of Barclays comments, regarding the delay and their suggestion of taking legal action, I would be interested to see this.

If you have any further queries, please feel free to contact me directly either by e-mail at lee.hancock@uk.experian.com, by telephone on 0115 8286485 or by writing to me at the following address:

Directors' Office, Experian, PO Box 8000, Nottingham, NG80 7WF

Yours sincerely

Mr L J Hancock

Hilarious!

Thanks for sharing that with us.

Hope your sheer bloody-mindedness will stretch to helping Experian starting their own battle with Barclays!

That is a very telling comment fom Mr Hancock at Experian isn't it? Excellent result Noomill and I think this should be made a sticky.

Oh errr. Dur! It already is it just got revived due to developments. You gave us an excellent lesson in how to methodically pursue a case to success. :D

P.S. I'm still giggling at your comment to the ageing yuppy Barclays solicitor having a hissy fit. Quality.

Mini series? Its turning into a full blown soap, like Dallas.

I keep expecting to find JR shot dead at the bottom of the stairs and Bobby Ewing in the shower, even though he was killed at the end of the last series but one, but that was just in Pam Ewing's imagination and that the end of it all, the entire cast are abducted by rock and roll lovin' aliens.

Or was that Dynasty or Falcon Crest?

Good result-I told you that LH would not be too happy.

Hope you have sent him the evidence-this happens too many times, where the DCA or Bank blames the CRA.

What a great read!

Congratulations! You are a hero, noomill060!

Barclaycard have issued me with an account following their purchase of Morgan Stanley cards last September. Time to produce the 'true copy' CCA is running.

I have a limited company business account with Barclays. In theory, if not in practice, there is no connection to be made between this business account and the three personal Barclaycard accounts for which I have make CCA requests. Any comments gratefully received.

Dun

PS

Sorry, my concern is that if Barclays 'lose' a substantial sum of money because even one of the Barclaycard account debts is unenforceable Barclays Bank will interfere with my limited company business account.
