So I shouldn't write back then? Just get on with the defence?

 

You could write back and argue with them but it wouldn't really achieve anything. They are not going to be swayed from their erroneous position except by order of the court.

 

I would just start preparing the defence, with references to the non-compliance.

 

On what date did you send the CPR 18 request, and when does the defence have to be submitted by?

I sent the letters out the same day I was told on here. I have them in my diary at home so will be checking later.

 

I think I have about 10 days more before I have to do a defence but again it's on my organiser which isn't with me

Also had problems with these idiots, they threatened to send sheriff officers to my place of work with a wage arrestment order and i work in a school so they definently use scare tactics.

Allocation questionaire came today! Bit lost now though! Read through all the threads but still a bit confused and I'm only on the first question

 

Do I want more time to try and come to an agreement or not? If I do will it make any differenceand I'll have to pay another fee or if I don't will it look like I'm being unreasonable?

 

I read through links on here but can't seem to find an answer! WElcome sent me a 'statement' the other day and I use the term loosly it was a short latter with just a figure saying how much I owe them.

I'd say you'd try to come to an agreement, then you'd need to write to them again after submittinng your AQ to try and do this, when they ignore you it would just show then as even more unreasonable.

 

On the other hand, not ticking it would save you a months wait

Unwelcome Finance as I like to call them.

they also do Unwelcome car finance bit like no car credit that went bust a few years back, BUT still can be found trading as Direct Auto Finance.

all in all Unwelcome Finance specialise in high risk loans so they should expect a hicup or two ;-)

if you have already tried to make an arrangement with them, then tick no.

 

 

I wouldn't - I know where you're coming from but bear in mind all you're actually doing is trying to make you look reasonable and them look like a****.

 

It doesn't actually hurt you in anyway and a months stay isn't the end of the world

The pre-action protocols apply before a summons is issued. Its up to you a bit with this one, but I would tick it as you want to appear reasonable and willing to avoid a hearing to a judge.

 

I would tick it, write to Welcome, and if they ignore you bring it to the court's attention. If they tick the box on their form and then don't try to contact you then I'd let the judge know this as well.

 

Its an opinion though. You may feel that you want this over quickly, and so not tick it.

They haven't just ignored me they wrote back saying they do not have an obligation to supply me with that information!

 

Also requested statements and things (used the templates directed to on here this site is great!) and they said no to that too
