Hello

 

Hoping for some advice...

 

I have a Barclaycard (Credit card) with an outstanding balance of approx £600. Not a lot I know, but enough to keep me awake at night!! I have other debts with other companies which I am currently tackling.

 

My question is I need to open a basic acct with Barclays (it cannot be any other bank as I need to link it to another barclay account that I opened abroad).

 

Should I first open the basic acct, get it up and running, then start my claim againt Barclaycard (credit card)?

 

If I start my claim (against Barclaycard),then attempt to open an acct with Barclays, will it show up on their system eventhough they are 2 separate companies?

 

Any thoughts on this?

Hi MBK and welcome to the BC forum,

Although Barclays are not famous for retaliatory action, I would advise that you open the new a/c first anyway.

 

Barclays and BC are part of the same Group and certainly share info, as would other banks that run connected credit cards.

Also, while we're on the subject, many people seem unaware that connected institutions such as Barclays and BC will transfer money between your a/c's without your authority.

 

Eg, if you owed money on your BC a/c and hadn't paid them for a month or two, when you get money paid into your bank a/c, they'll transfer what they want to the BC a/c and there's precious little you can do about it. :eek:

me thinks it is better to get the acct up and running before I tackle Barclaycard.

 

I am off to see Barclays Bank tomorrow....hopefully will get accepted for their basic acct. I will then wait a month before I start my claim.!!

Yep, Get the bank a/c up and running first.

 

If you're just reclaiming the charges from BC, you should get them refunded with little fuss or delay. Read other BC threads and you'll see what's happening at the mo. :cool:

 

The only reason for delay would be if you were claiming full interest on the charges, at the contractual rate. In which case, you'll have to file your claim at court.

 

BC will defend against it and will refuse to settle until right up to the court date. :eek:

Hi

 

Thanks for the tip.......I would like to get all that is owed to me. But on the other hand don't fancy going to court!! Maybe will wait until I have added up the charges and see if it will cover the debt. I suspect it will....

It wont get to court.

 

Barclaycard know that "court" is a scary prospect for most people

 

But... as many here have discovered, Barclaycard are even more scared of having to go before a judge than we are!

 

If you stick with your claim for return of YOUR money, they bottle out and make a complete offer of settlement, on your terms, at the last possible moment, usually a few days before the hearing date. ;)

Hello

 

I am hoping I might get some help on how to deal with with Fredpay (DCA).

 

I owe Barclay card approx £600. The majority of it includes charges and interest. Barclay have passed this debt to Fredpay who constantly write and call me. I know better than to speak to them, but I do want to communicate with them on paper.

 

I would like to know apart from sending Barclay SAR to get the ball rolling, what letter do I need to send to Fredpay?

 

I am pretty sure by the time I reclaim from Barclay, the overall debt would be less than £200.

Send Fredpay this letter. Edit the letter to suit, DO NOT SIGN IT and send Recorded or Special Delivery.

 

Name/Address:

 

Date:

 

Dear Sir/Madam

 

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the CPUTR 2008 and the Office of Fair Trading's Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions.

 

I/we look forward to your reply.

Don't forget to include a £10 postal order to Barclays if you are going to send a Subject Access Request.

I don't suppose you have the correct address for 'Fredpay' or should I use the address on their letters?

Hello

 

I have recently received a 'debt notification' letter from Wescot. Its regarding a debt I apparently owe to Barclaycard.:rolleyes:

 

I intend on sending a CCA letter (via special delivery) to Wescot and a SAR to Barclaycard. My question is does anyone know the correct address for Wescot:confused::confused:

 

The letter has 2 addresses on it - PO Box 137 Hull HU2 8HF &

Kyleshill House, 1 Glencairn Street, Saltcoats KA21 5JT.

 

Which address do I use?
