I am receiving confusing conflicting advice re: repossession hearing. Can anyone help?

Hi there, affixed is the text for Q.27. There may not be enough room in the space on the form so you need to write "please see affixed sheet".

 

When you have copied the text onto a sheet write the claim number on the top left hand corner and your names on the top right hand corner and staple securely to the N11M.

 

Make sure you quote the claim number etc on your letter to the court asking for it to be transferred to your local court.

Hi Ell-enn,

 

The date at the mo is 07/10/2008. I don't know whether that will change if they grant the transfer to a different court.

 

I'm struggling with the N11M. I feel like I'm repeating myself. We have other debts as well as mortgage but we have arranged agreements on these. Is q 22+23 for non priority credit only? Also q 2 Am I disputing the claim? q 5+6 is my mortgage a regulated consumer agreement?

 

Also the arrears section- q 7-10. We do have an agreement but we are going to cancel it to make the repayments more manageable.Is this only regarding arrears or do they want to know if you have paid your normal monthly mortgage payment? I know Oakwood will refuse the £100 but we had arranged to start paying the arrears end of this month. Do we pay it anyway regardless?

 

Do we have to fill in BOTH n11m's? I don't work so it seems pointless.

Hi there, just fill in one set (write your name under your husband's in the Defendant's box).

 

Q - 22 & 23 are for non priority debts

Q - 2 - yes (if it is correct)

Q - 5 & 6 - No

 

Q7 - is for any payment to the mortgage

Q8 - yes, then write underneath "please see Q27"

Q9 - Yes

Q10 - £100 per month

I can feel a tiny glimmer of hope. Once I have completed the form copied and sent recorded. The statement is great btw..even I feel sorry for us after reading that :D

Hi, you're not dim at all - just not used to filling out these kind of forms. Make sure you take a photocopy of everything including your letter asking for a transfer.

 

I expect the date of the hearing will change when it is moved to a different court. Once you have sent the letter you will need to ring the court in a few days just to check they have actioned your request. You can never assume anything is being dealt with unless you're told (unfortunate, but true)
