      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have recently taken out a loan with logbook loans and have been told that my weekly repayment of £24 per week is made up of interst and a small amount of capital. What i want to know is if this is correct. In effect i am hoping to pay this off in seven months. I understand that my interst rate is 12.16% per week and my repayments are as i said £24 per week, if i maintain my payments i estimate that in seven months i should owe about £330 or so,. as my agreement is an 18month agreement would i have to pay a penalty as they told me they encourage people to pay off early. THE earlier you pay the less interst you pay. So why do they put you on a 18th term agreement.

Repayments are calculated in accordance with the terms of the consumer credit act. As a very general rule (very general) you should expect to pay two months interest on top of what you owe. You would also be advised to get a settlement figure up to one month before you intended to pay off the loan as most loan companies allow for up to 30 days to settle (in other words another month of interest on top of the two).

 

Finally - as I am sure you are aware from the forum be very careful dealing with LBL. Make all your payments bang on time - never go into arrears no matter what the circumstances - they are a very nasty firm with highly dubious practices.

After all we read on here about LBL we settled our loan with them last year ASAP. I have to say hand on heart we had no problems with LBL, but we always paid on time, except for 3 occasions when we paid a few days late.

They did add charges for these late payments but refunded half the charges when we got the settlement, so didn't pursue. Just glad to get rid of them.

If you can settle do it at least then you don't have to worry about possibly losing your car anymore lol.

This and the overdraft were the most satisfying debts to clear for me.

Oh and I will keep the settlement letter forever lol.

Btw I am no expert just give notes based on what I have read on here and other forums/sites, plus my own experiences and investigations.

 

All ccj's now dropped off file, 2 yrs to go to clear file.

All old debts either settled or made unenforcable.

Citicard ppi-with FOS finally paid 8 months after offer through FOS!

an 18 month contract at there apr

do you know/understand what the total ammount repayable is under the agreement. if charges are added, at there interest rate, it would take a life time to pay it off

 

please give details so we can help as this is prob a new agreement, before its to late

I dont see their early settlement figures as being worth it, I took out one £500 loan and was advised wether I keep it a week or 4 weeks I would only pay £100 on top so I kept it for exactly 4 weeks and it cost me £831

I'm fighting back and ready to go :D who will be my first victim? LBL, Brighthouse.
