Hi

I currently owe about 7500 on my cr cd. I now cant make the min payments (last one was due end of May). I've made a token payment.

my account is with their collections. i've spoken to them a couple of times explaining cant afford payment, and asked if they would accept reduced payments and freeze the interest.

They've said that their policy had changed and that they wont freeze the interest but can reduce it (to about 6%) on a reduced payment plan up to a year, to be reviewed in 6 months! (i was hoping that they would freeze interest so i any payments I can afford to make would start clearing the debt!)

Any help/advice would be greatly appreciated!!! Thanks

Hi, Ford.

 

Send the DCA a CCA request, letter 'N' in the Templates Library.

Send this with a £1 Postal Order, send it recorded and don't sign it.

 

Also send the Original Creditor a SAR.

Send this with a £10 Postal Order, and send it recorded.

 

This will let you know what charges have been applied to your account and what you can claim back.

luckily, its not with a DCA (yet!)

apologies if this has been discussed elsewhere (am gradually reading thru!); re CCA - what happens overall then when there is no enforceable CCA?

re charges - are the £12 fees for late payment/overlimit still reclaimable?

I have had dealings with Lloyds over an old Credit card for which they don't have a CCA Agreement (I have this in writing yay !!) and the chances are if this account is of any age then they won't have one for you. It is up to you what you do then, however it does strengthen your hand in settling and dealing with the account, so if you intend paying up and want to claim back the charges then do so or if you want to go down the FFS route then again your position is good. For me I have sat back for now until I am in a position to deal with this and can take the credit score (mine is knacked anyway), haven't paid anything for well over a year although they did set 1st Credit on me recently, had some fun messing them around and then told them and their "solicitors" where to go.

Think it's either one or the other,

 

No CCA No enforceable debt.

 

Re: Re-claiming charges, I'm sure the court would find this false enrichment.
